I have a child support question?

Ok my friend is paying as much as she could on child support. She lives in another state now due to unfortunate circumstances. She stills pay for it now. My friend scared that since she behind in child support, mind you she still paying for it, she scared that they might take her income tax. Can child support take income tax even if she stays in another state? She wanted to split half her income tax to child support and keep the other half to herself. Can they still take income tax. If filed in another state?

    They can take her income tax return. She's an idiot. If she is getting a return, she should adjust her deductions so that less is paid to the IRS. Then she would have more money each month to pay down her debt. And no, she doesn't get to choose how much of her tax return they take. And what state she lives in is completely irrelevant.

    They will most certainly take her income tax, no matter where she lives. They will take whatever amount she owes, whether that's half, three quarters or all of her tax return.

    The state will only take the amount she owe`s. If that exceeds her income tax, then she`ll still owe that total. If she keep missing payments ( even though she`s sending money in, its not the full amount. So its not a full payment in their eye`s. ) if she dosn`t start sending in her full payment, and if she gets thousands of dollars behind she could go to jail.

    The Attorney General's Office can intercept any income tax or other payments due to go to your friend as long as she has arrears. Even a 401k payment due her , if she had one. My nephew's father went to Afghanistan and my sister lives in Texas, and the Attorney General was still trying to track him down and collect whatever payments they could for his back support owed to my sister.
