If this judge thinks that lethal injection is too harsh for a convicted murderer...?

then how about if we kill them by the same methods they used to kill their victims?

I would much rather see that punishment. If you torture and kill someone over several days, then we get to do the same to you. You rape someone and then kill them, we get to rape and kill you.

I think the murderers should suffer the same fate as their victims. Lethal injection is much too nice for any of them.

    Kozinski has a long history of inserting outrageous or humorous remarks in his opinions. It's kind of his thing. I don't think this is meant to be taken seriously (and the fact that that article refers to it as "a modest proposal" should be a giant clue).

    Also, Kozinski isn't saying that lethal injection is too harsh. Not by a long shot. He's saying it's incongruous to handle executions like medical procedures.

    I haven't read the Arizona case, but my understanding is that the whole protracted death row process is what the court found to violate the 8th Amendment. Not just the method of execution.

    Your not thinking that the reason some people go on a rampage raping and killing spree, be it one or many, only hopes they are caught and killed, or not caught at all. The reason is..they don't want to suffer the consequences of their behavior and be locked up for life in solitary confinement. Which is what they deserve, and enough for anyone to to make sure that is the result. Imo, and the opinion of many.

    The state legislature decides what is the legal form of execution in a state. This form must be in keeping with the court's decision on what is "cruel and unusual punishment".

    who is going to rape and murder someone as a punishment ?

    why do you get to stab someone to death ?

    A little document called the US Constitution.

    Just because you keep your blood lust marginally in check by rationalizing the use of it as OK against criminals doesn't make you any less a sociopath.

    You're exactly why they had to prohibit torture in the Constitution.

    Nothing shows that killing is wrong quite like killing someone who has killed.

    Perhaps soon we can start cutting peoples' hands off that shoplift?

    I don't think you'll find many (any?) people that don't believe this qualifies as "cruel and unusual" punishment.

    Anyone who takes an innocent life should forfeit their own. Personally, I don't care how its done.
