What will happen to me?

Hi I made the biggest mistake of my life. I was talking to a girl she lived in USA I live in UK we started sexting I was 15 at the time she was 17 know I'm 16 my foster perent stole my phone and saw the pictures of my penis, I am in care, I have deactivated my Facebook so they can't see anymore, we'll I can tell them. But also I have many other bad pictures of me on my phone gallery. I have been watching porn a lot so they are doing a meeting with my social worker. What will happen I want someone who knows the uk law... Thank you so much.....

    Technically you have committed the serious offences of making, possessing and distributing indecent images of a child - namely, you. No wonder social services are involved. Adults who get caught with child pornography are almost guaranteed to get a prison sentence.

    But what they will try to do in conjunction with the police is keep you out of court so you don't have a criminal record and being on the sex offender register to ruin your future life. If you're a registered sex offender, you can say goodbye to any chance of getting a job easily.

    In the UK your sexting is an offence under at least two laws:

    Section 1 of the Protection of Children Act 1978 (as amended by section 45 of the Sexual Offences Act 2003) makes it illegal to (produce and distribute) publish sexual photographs of anyone under 18. This would include selfies, and it does not matter whether "you agree" to the photos or not - it is still illegal.

    AND

    You are committing an offence under section 43 of the Telecommunications Act 1984. This section deals with "improper use of the telecommunications system" and it expressly bans pornographic and indecent images being transmitted. The UK mobile phone network is most certainly covered by this law so sexting is illegal regardless of the age of the person sending the image.

    If you are not caught then nothing will happen to you. The authorities no monitor every single photograph that is sent between mobile phones in the UK so your chances of getting away with it from that point of view are high.

    BUT if someone reports you then you could be in trouble and may have to appear in a magistrate's court. For first time offences you would probably be "bound over". This is a sort of legal warning that means you walk free from the court but if you offended again then you would suffer a more severe punishment.

    Are you absoluetley sure that your foster parent "stole" your phone? This is very serious accusation and if it is true then he can be sent to prison. Did he really just pick it up and look at it, and did not have any intention to permanently take it from you? If you are certain that he really did intend to steal it (this means that he intended to keep it and never return it) then you MUST report this to the police.
