My Husband is in court?

My husband is in court on 20th August for stealing £11.70 worth of food from his work late at night (nobody there).The Freezer is outside behind a gate which neither of them are locked.The Police took the food back off him and put him in the jail cell for the night (he was drunk)

What will a judge say to him as this is his first time.

    Firstly, as this is presumably in England, there won't be a judge. He will be in magistrates' court before a bench of three volunteer magistrates who act as judge and jury.

    This is theft including breach of trust (as it was from work) which, plus that he was drunk at the time, is undoubtedly why it has got to court at all for a theft this small. The chairman of the bench is likely to make an indignant short speech about how he shouldn't have been so stupid, and being drunk is no excuse because you're supposed not to be drunk, especially at work, and then impose a fine which he or she will have decided on in discussion with the other two magistrates. If your husband has any sense, he will plead guilty as he was caught red-handed with the stolen food. This has the bonus of reducing the sentence and is also likely to get it all over and done with in one hearing.

    There is a small possibility that he might actually face a district judge (magistrates' courts), but probably not. The whole wigs and gowns business you see in TV dramas is in Crown Court, and only the most serious 3% of offences ever get there.

    how the hell are people off this site going to know what the judge will say

    they do not have a written scripted saying for every crime

    what about the health and safety aspect of your husband being drunk at work ?

    Judges mostly look at offenses, if its his first time he wont get hit too hard, just a little. possibly a fine, a class, and community service or stuff like that, they deal with alcohol alot. Just tell him to get it together and this wont ruin his life
