As of now there's nothing to say he will, Its still under investigation, Although I doubt murder charges will be brought up, more than likely manslaughter if anything, and then you'd still need to be able to convict him. Ward had no business walking/running out onto an active race track in the first place, It was his temper that got him killed, not Tony's, I don't know if you've ever driven a sprint car or any other dirt track car but you steer them with the rear wheels as much as the front, so Tony may have indeed been trying to avoid the knucklehead

Watching the video, it sure sounds like Tony Stewart ACCELERATES at the 34 second mark right before he hits Ward. They were under a caution flag, so why would he be accelerating? It also looks like he swerves toward Ward on purpose. Go to a website like deadspin and check out the video. It looks damning to me. Other drivers avoided Ward, but Tony accelerated and swerved into him. The two had been battling all race apparently, and Tony wrecked him into the wall. A driver of Tony's skill can easily avoid a person on the track. They were not driving that fast.

One car slowed and swerved, ward moved away, tony ran him down, ward tried to move, tony made sure he would not miss him. That shows intent, ward should not have left the car, but tony could have missed him, he chose not to. It only takes a fraction of a second to make a decision, and the possibility he can get away with it, entered his mind. If doesnt get convicted of first degree murder, the ward family should look to a civil suit. By the way, driving for sport, is stupid.

It could have been prevented on Tony's part. Looked to me like Tony was playing chicken with him thinking the boy would jump out of the way. Wrong on Ward's part but murder in my opinion on Tony's part.Tony's tires were straight until he ran over Ward. If Tony was trying to avoid Ward his tires would have been turned a sharp left. It's as if Tony's let his smart a** attitude give him a momentary lapse of judgement. That's murder in my opinion.

The state should charge voluntary manslaughter, and vehicular manslaughter. Vehicular would be a slam-dunk, and voluntary easier case to make because all prosecution would have to do is prove he willfully took actions (running throttle, manuevering near Ward, etc) to prove willful conduct.
