Scrap Metal?
So, I live just about a mile from this abandoned railroad track, the track its self was abandoned in 1903 and the railroad that owned it went out of business during the Great Depression. Parts of it have already been torn up and all that remains are just a few long scattered segments of rail, obviously people have been scrapping it.
So, my question is if it would be legal to start scraping the rail road.

No it isn't. Unless you have proof of salvage rights a scrap yard will not touch railroad scrap of any kind.

The spikes are nice collectables, especially if they have a logo of some long defunct company on them.

My guess is that someone owns it. With their permission, you could scrap it. Otherwise, it would be theft if you don't own it or have the owner's permission.
