Obama would be within his rights but it wont be him. Some undisclosed person is doing this and well they should be. Republicans have no room to complain or any area to run away.

Torture does violate US and International law.
That being said no US President has ever prosecuted any illegal actions of a previous President.
For Obama to do so would be a Constitutional battle and not be good for the nation or the Democratic party in general.
What he could though is to grant Bush Jr and the members of his cabinet involved a pardon.
That would lay out the illegal activities, define those involved, but no legal action would be taken.
This would define in history the illegal policies of the Bush Jr and Cheney regime.
And it would achieve the necessary political dagger the Democrats could drive into the GOP.

Problem for Obama is that he has been aware of it since he became President. Plus, some of it has happened since Obama took office. Think about a guy by the name of Osama Bin Laden and what methods were used to uncover his where-abouts.
