Is it illegal to create a web-based software like Windows?

I am planning to get into a unique industry: web-based computer

However, I am afraid with the copyright issues (if any).

Update:

The web-based software will be like Windows 8's design.

    Copyright law covers the creative expression in an original form, and its derivative works. Computer software is a "literary work". Copyright gives the owners the exclusive right to duplicate and distribute the work or derivative works, or rent it out, or publicly perform for profit, among other things.

    Copyright law does NOT cover the idea, function, concept, principle, system, method, process or discovery described in the work. 17 USC § 102(b).

    As long as you are not copying the code you can do it. You can follow the example set by Reactos or WINE.

    But, replicating the design may be an issue, you should read the windows 8 terms and conditions from the Installation CD
