Is it illegal for a video clip of a topless each to be on the web if it shows persons under 18?

It isn't hard to find photos from topless beaches, but what if one that shows a large section of the beach contains a person under 18? How about for video clips? Are they considered 'kiddy porn?'

    How would you know just looking at them? When I was 21 I still looked like I was 17. This last summer I had a high school kid hit on me at the beach, he wanted to know which high school I went to, and I was 22 at the time. I go into a club with a bunch of girls even though the waitress rarely asks them, I get carded every time. The same applies to the beach just looking at a girl laying out on the beach there is no way to really tell how old they are.

    Certainly could be, it easily fit the very wide statues in many states, so it will come down to your intent.

    By 'could be' I mean a prosecutor 'could' push the charge against you if they felt like it.
