Renter eviction question, please help! My father went to court yesterday and his "judgement" is confusing everyone. We are afraid he has?

Misunderstood the judgement since he insists it wasn t for eviction in the first place but it absolutely was...

The Case Status is Closed. The judge ordered for the landlord to receive $3484.75

The paper says: Grant Possession. No

Grant Possession if judgement isn t satisfied by the time of eviction. Yes

My father gave $950 and asked for a repayment plan, the building manager is taking the money to the landlord and the repayment proposal.

My father says the landlord has 10 days to decide, the building manager says he may not accept it...

Is my father in denial about being evicted? I m concerned because he s very sure he isn t getting evicted. I have to ask because he is a hot head and gets caught in his own thoughts.

    Complete denial.

He has to pay $3484.75 within 10 days or he is evicted. He has paid $950, and owes another $2,534.75 or he will be evicted. He does not get the $950 back. In fact he has a money judgment against yim which the landlord will pursue even after he is evicted - the $2,534.75 owing

My father...asked for a repayment plan. - this will never happen. If he could not pay it before the eviction, then he can't pay it after the eviction. The landlord would be nuts to let him stay because he simply won't pay the rent, or the back rent, and the court process would have to be restarted.

My father says the landlord has 10 days to decide - nope. Your father has 10 days to pay before the sheriff locks him out.

Oh, and the court doesn't "explain judgments" They will tell you to call your attorney for legal advice.

Thank you for taking the time to answer. Basically my dad stopped paying rent because his heat wasn't being fixed. Unfortunately at the same time he changed the locks and didn't tell the landlord. He didn't stop paying over the winter, he stopped in May and he didn't open an escrow to save his payments to give when he was fixed. He assumed the landlord would just call him and ask what's up. Even though he lives on a property that has 200 apartments.

His entire family has been telling him he has to take the landlord to court, not just stop paying. He got eviction papers abs said "I'm getting my day in court!" No, your landlord is... Guess what, the judge said he should have sued the landlord because everything he actually did made it impossible to believe his story.

My dad is an angry, loud man who tries to intimidate so after the judge ignored his claims I'm positive he heard NOTHING

I would contact the court for a fuller understanding of the ruling. Explain to them that you father isn't clear on just what the decision actually means.

To me, based on the limited stuff here, I would GUESS that if the landlord refuses, then your dad is out. However because this is a legal thing, you better be darn clear on it all. Contact the court and ask for a plain English understanding of what the judgment means.

Ok he wasn't evicted yet, but he will if he doesn't pay.

"Grant Possession: No" Means he has not been evicted (yet).

"Grant Possession if judgment isn't satisfied by the time of eviction: Yes" Means that he will be evicted if he doesn't pay in full by a given specific date.

Call your dad Cleopatra cause he is queen of denial . your dad can stay if the ages up 3500.00 usually ten days...if he can't do that the landlord gets to keep the 950.00 and dad still gets evicted.

Your father will be evicted if he does not pay in full by the time the sheriff show up to remove him.
