Am I being too patient with this seller?

One week ago I order a motherboard from an eBay seller. I paid for expedited shipping, but he was unable to ship it or respond to my questions until a week later. His explanation was that he was dealing with a family emergency. I said okay and wished him luck. He did upgrade the shipping to priority 2 day. I received the board 3 days ago, but without one of the parts that was said to be included in the auction. I sent a message the same day over the matter and still haven't gotten a response yet.

The missing part is the rear I/O shield that covers off the connectors to the case.
