HOV violation ticket - California?

Hey,

I was driving to class today morning and I was in the left most lane (non HOV) and the traffic in front of me immediately stopped, I switched to the HOV lane in order to prevent a collision. I was in the lane for about 30 seconds looking for an opportunity to switch back into my normal lane, in this time a cop saw me and pulled me over and cited me for driving in the HOV lane. The cop said there would be no points added to my license so insurance wont go up? I am 17 can someone please help me out with this. What do i do?

Update:

I was not driving too close to the vehicle in front, I was being tailgated and had I slammed my breaks I would have been hit in the rear by the truck behind me.

    First, make sure the officer was right. Driving solo in the HOV lane is a violation of Veh C 21655.5(b). That is NOT a point. Unlawfully entering or leaving the HOV lane is a violation of Veh C 21655.8(a). That IS a point, and you will want to go to traffic school to keep the point off your record.

    BTW, if you are being tailgated, then you need to leave MORE space between your vehicle and the one in front. It is always a drivers responsibility to leave a safe distance between the car ahead under ALL conditions.

    LOL! So, your defence against the HOV ticket is that you were driving too close (i.e. dangerously) to the vehicle in front of you.

    pay the ticket....no points...what are you going to tell a judge...your honor sir, how am I expected to pay attention to the traffic directly in front of me when I am looking right texting.....at the last moment to avoid a accident due to reckless driving I changed lanes illegally......I suppoes you would rather I rear ended the car in front and possibly killed a child than simply drive in the speed lane without peril......recent studies show it takes till age 25 to completely pull your head out of your a=s=S and start using common sense
