Transfer of property?

Update:

My partner and I are not married. We bought a house 4 years ago together. We now wish to remove his name from the property. What is required to do this? Would stamp duty be payable (again?!)?

    You cannot just remove Partner's name from your property deed. You must refinance in your sole name. At closing, you will make the alteration to your deed. If you cannot qualify for a loan alone you may have to sell.

    Stamp duty will not be payable unless the house is sold. It is paid by the buyer.

    Another time, do not buy property with someone you are not married to. As you have discovered, unwinding is a huge headache.

    I have no idea what stamp duty is. You can both either sign a Quit Claim deed to you alone or you can both sign a new Warranty Deed, selling the property to you alone for 1 dollar. I suggest you both see a lawyer so that you both understand what you are doing and choose the most appropriate and least expensive way to change the title.
