Would it be okay to sell a free phone from a bank?

I am thinking about opening an account at a bank that is running a promotion giving a free phone to new customers.

Would it be illegal to open the account, get the phone, and then sell it for cash?

I want to do it, but not if I'll get in trouble. It says activation required, but would it be okay to not activate it and just sell it?

    It would TOTALLY depend on the contract associated with the giveaway but I would say NO!!!

    Most offers like this require you to activate the device immediately in your name the reason you are getting it free is because it comes with a service contract requirement that will pay for the "free" phone over the next few years. You better ask BEFORE you sign a legally binding contract because the bank will have all your financial information to handover to the phone carrier. Your free phone might cost you a $1000 or more in a service contract.
