Loitering? What are legal places to sit AND illegal places to sit?

    There's a legal show out of Austin, Rule of Law on a low power radio station

    they can answer your question from a Texas viewpoint.

    That show is live on most Monday, Thursday and Friday nights. You should call in if you can. The shows start around 8:03 pm

    Know how to talk with police and invoke your rights and you'll have better success sitting in public places and not getting charged with loitering.

    You should generally carry a book, magazine, paper to read or something to write

    on so that you're doing something.

    You're in a public place, a public place is "public" that's yours to use.

    If there is a bench in a park, that is an invitation to loiter, but not sleep. If you are impeding other people in a public place, that's illegal. People hang out in the street because they want to be seen. Few actually want to see them.

    Well, if you go to a cafe or a restaurant and just occupy space without buying anything, you're probably loitering. If you go to the park and just fall asleep for hours on end, you're probably loitering. This should be common sense.

    It isn't where you are, but what you are doing.

    As a general rule, loitering is defined as "...remaining idle in essentially one place and shall include the concepts of spending time idly, loafing or walking about aimlessly."

    The law normally targets those that are interfering with others, drug dealers, prostitutes, pick pockets, and other criminal acts.
