Can I get a refund? Or can she sue me?

I'll try to keep this short. My friend commissioned an artist on tumblr. She finished his commission overnight/within a week. They were 'pay what you want' commissions that started at $5/icon. She was way underpriced,and because my friend had such a good experience, I decided to pay what I felt her art was worth. Two pieces for $50 total. I sent her the money via Paypal, and messaged her to let her know. This was two months ago. I have not heard from hear whatsoever, despite my multiple attempts to contact her (which I can prove). It's nearing on three months since I paid. In the meantime, she has done some commissions from people who have ordered after me, and telling others that their pieces will be done within a month. She's also been taking on more commissions. I messaged her yesterday, giving her a 24-hour deadline to reply to me or I would be just getting a refund via paypal. After the deadline was up, she finally replied, but only to say 'be patient' and to link me to a post she made AFTER I commissioned her, saying 'i don't do refunds'. Can I get my money back? I'm honestly sick of this and would like to just be rid of her.

    Open a PayPal dispute. This is no way of dealing with clients. I also do commissions but I always ask for the payment after I am done with their art work. This way my 'no refund' policy makes sense because I've already rendered the graphics service before I am paid.

    You can sue her, but the cost of filing the case in small claims court will likely be around the same as what you will be reimbursed.

    Legally she cannot simply provide no product or service then state that refunds are not available. Where I live she can be reported to the better business bureau and ASIC. You would have bodies like that in your country. Obtaining your $50 refund through them might not be what they would deal with though as the amount is too low.

    You can also open a Paypal dispute, but it could have gone beyond the timeframe where they will take action.

    It's not anything the police would get involved in either. They will advise you that it's a civil matter.

    You can post negative reviews about her business practises online and that may give you some satisfaction.

    I'm wondering though if she if going to complete two works that are exceptional for you. Five dollars does indeed seem to be a very low price and if she follows through with the work for others then I would say she has something special planned for you. She would really appreciate you paying more without any suggestion on her part. Artists can be funny like that and I'd say she is already part way through or is perhaps waiting for a day when she feels especial artistic flair.

    I realise you're sick of awaiting the arrival of artwork that you have already paid for, but since you have nothing to lose, perhaps it would be good to wait.

    Text her back and say that you are prepared to be patient, but would like to be advised of an approximate timeframe for completion. I'd advise you do so in a polite, friendly and warm manner, as artists tend to be led by their emotions. You may yet receive artwork that is worth the wait.

    Did you get the art or not? If not, you should have a refund.

    Avril Lavigne always has and always will suck and that's a fact. Her hardcore fans deserve to suffer!
