Social Security last payment.?

From what I understand SS payments are made for the month previous. For example, Feb. payment is for the month of Jan. so the person is entitled to that payment even if they die in February.

Now I read somewhere that SS looks at the payment as a paper check even if direct deposited so if person dies before the day of receipt of the monies they are not entitled to payment for the previous month as SS looks at it as they never "signed" the check. My husband died on Monday and payment was direct deposited on Wednesday. Does SS have the right to take this back or not?

Yes. It doesn't mean that it isn't due (it is in this case) - you need to file form SSA-1724 if the bank returns the benefit, which you can download, complete and mail into your nearest SS office (address at ssa.gov - you just input your zip code) so that you will receive the underpayment. The benefit will be re-issued to you.

Also, call 1-800-772-1213 and make an appointment to file for the one-time death benefit of $255 unless you are receiving benefits as a spouse on his record. If you are drawing as a spouse and their records show that you live together payment of the $255 will automatically come to you once they input the death and the system processes it. And, if you are at least age 66, you will automatically be converted to widow's benefits. In other words, only if you are not drawing as a spouse on his account you need to file an application for the $255.
