Will my mom get in trouble if I dispute a debt in collections?

My mom opened a capitol one credit card in my name without telling me, spent the $400 and never paid it back. It's in collections now. If I dispute the debt is there a chance it could lead back to her and get her in legal trouble? She screwed me over I know, but I do not want her to get in trouble...

    I think you are going to have to not tell them and pay it if you don't want her in trouble. It would be different if she stole a card off you and used it, then you could decide on the prosecution element yourself, but she has defrauded the card company who won't care at all about her getting in trouble.

    You have two choices: 1) pay the $400 and all the collections fees, and pretend that you opened it, or 2) file a police report accusing your mom of theft, then send the police report to the credit card company.

    She committed fraud. You can cover up that fraud and pretend that you opened the account, in which case you will owe the money. If you tell them that this is not your account, they will try to figure out who did open the account. If they find out it was her, she will be in trouble.

    She did this to you. Stop trying to protect her from her own actions.

    She should be in trouble. She committed fraud and ruined your credit. Some mom you have there kiddo.
