The act of being here illegally is criminal in its own right. You violated immigration laws and you also broke through the border coming here. Anything else that you do here illegally, while you are here - add that to the criminal actions you did just getting here illegally.

For the first improper entry offense, the person can be fined (as a criminal penalty), or imprisoned for up to six months, or both. For a subsequent offense, the person can be fined or imprisoned for up to two years, or both. (See 8 U.S.C. Section 1325, I.N.A. Section 275.)

Some people will be in violation of their visa limits making them illegal. They arrived legally but overstayed. Some people arrive illegally, consciously avoiding the proper ports of entry, required visas, etc.
Many here illegally are also guilty of identity theft and illegal employment.

Too many variables to answer.
The answer would vary widely between a person that was brought in by their parents as an infant, a person that entered on a visa or visa waiver and overstayed and a person that illegally crossed the border.

Oregon State Governor just made an executive order to not enforce immigration law. At the same time she said she is complying with all state and federal Laws. There are some laws being broken and she will not enforce them

You should ask the 3 American hikers that were detained in Iran and accused of being spies.
I'm sure they can tell you exactly what laws are being broken.
