What are some arguments for sampling music being illegal?

Making unauthorized copies of someone's sound recording is copyright infringement. It's as simple as that. Personally, I think there should be a de minimis defense or it should at least be easier and less expensive to clear short samples. If you take so much of the sound recording that you need a license to the composition (for example, Puff Daddy), that's not the type of sampling I like.

Do we really need any arguments other than the fact that sampling music is stealing art that someone else painstakingly (and expensively) created, and you have stolen it to use for your own capital gain? Is there any possible argument for sampling music to be LEGAL? Should it not be illegal to steal?
