Yes. The intent at the time of the crime, the state of mind and criminal intent at that time, are relevant.

no, i think they would be tried as an adult because some minors under the age of 18 are even tried as adults..

the person then would be tried as an adult for the criminal complaint. The only reason to await charge would be if the minor had problems affecting their mental capability and were in for example a behavioral institution. I would think then the charge had been met in the imitational time served.

It depends on the law where the crime was committed and the crime.
