Will I win this court case about a dog?
I went to court today because my leashed dog killed an off leash dog that ran up to him. It wasn't A vicious kill, but more like he just put his mouth on the other dogs neck. The dog was only 2 pounds and unfortunately died right then and there.
I went to court today and the judge was very short with the case. He was talking about "well you should owe her something. Not all of it but something." I proceeded to tell him that it's the law. I was following the law. It's not my fault her off leash dog came up to my dog. He dismissed us and told us the decision will come in the mail. But that makes me wonder; do I have a possibility of losing? I thought it was a clear case. Her dog was off leash and mine was on leash. It should be end of story. What do you guys think?

The judge is an @sshole. I'd fight it with everything I had.

but, it IS your fault. since you presumably are not a child and presumably know how your dog reacts in situations as this one, it was your responsibility to do more than just leash your dog and walk outside.
this IS a vicious dog you have, you used the term yourself in your question, the attack was unprovoked, the little dog did nothing other than run up to yours and it was instantly killed....for your information I was witness to an attack similar to what you describe....this dog was a bouvier a large powerful dog whose owner kept her dog very close, just a few feet from her hand.. suddenly a puppy, just a few months old came scampering away from its owners up from a playground and rushed up to bouvier... what happened was unreal...I hope never to see such horrific scene again.
I never saw this dog/owner in this park after........I hope you do likewise and keep your dog AWAY from civilization evermore.

Obviously you failed to control your leashed dog as you're suppose to be doing, as well as being vigilant to your surroundings and may have been able to take evasive action to prevent this from happening.
It's not just having the dog leashed, short leash under six feet or less not a flexi-leash, no one can control any dog on a flexi-leash, but having it under control at all times.
The judge has already made a decision, and you have to abide by the judges decision...when it "arrives by mail"???!!!
Whatever we think doesn't matter. What the judge decides is what matters, and is final. Did you provide witnesses along with photos/videos, date/time stamped to corroborate your story, which may have helped?

I`m on your side as her dog was off lead, but I don`t know the "ins and outs" of the issue and the laws of your state.
Also if there was no individual witnesses to the event, then its her word against yours surely!
Unfortunately its usually the "Judges word is Final" so I guess its a matter of waiting to see what it is.
I`m very surprised that a decision is coming by mail as that is not usually normal practice in "cases of this nature". Not in the UK anyway.
I expect you can "appeal" if the decision is not in your favour.

Varies by local law, and no one knows where you live or what the law says there. In my city, you would be wholly financially responsible for the death of the dog. The other owner would be fined for having their dog off leash. Dog bite law where I live makes no allowances for circumstance, you are responsible for damages caused by your dog, period, and if you were not able to prevent the bite, your dog is automatically deemed not under adequate control.

We cant say in any truth we not being the Judge. And having no understanding of the intricacies of your local byelaws.. And ya is Worldwide also.
