Paid for 2 pack, received 1 pack. Seller won't refund shipping.?

I asked this a couple days ago in a different category without answers. I'm hoping for some advice.

I ordered a 2 pack of floor lamps from a second party seller off walmart.com. The ad on walmart.com as well as my receipt indicate that it was a 2 pack. I paid $268 for the lamps and $25 for the shipping because these are heavy lamps. While I was at work, the company emailed me to say that there was an error, and the ad should have only been for 1 lamp. They told me to contact them ASAP. I didn't get the email until after work, and they had already shipped the single lamp when I tried to cancel.

I believe that the price was way to high for a single lamp. I've contacted them about a return, which they say they'll do, but that they will not return the initial shipping fee and they will not pay for the return shipping. The return shipping is about $35 due to weight. So, basically, they are saying that they will refund the lamp price, but not $60 in shipping costs.

At this point, what are my rights? I am thinking about requesting a chargeback on my credit card. I have receipts and screen shots of the ad (which is still up and incorrect). Thoughts?

    I would go with a charge back on the credit card - they should have waited for a reply from you before shipping basically half of your order (as you understood it). Tell the company you are just going to contact your credit card company - this costs them money in higher fees when they don't settle it without intervention so it might change their tune. Also start contacting Walmart customer service - while this is not a walmart supplied product it looks very bad for them to have rip-off company on their website and they need to know to get involved with straightening it out.

    Source(s): Similar thing happened to me on Amazon (non-amazon seller) and Amazon made it right very quickly. (Walmart wants to compete with Amazon so throw that in their face if they are not helping you).

    They ONLY charged shipping for what was actually shipped. You have ZERO case.

    Talk to Walmart first since they were ordered on Walmart.com. I believe that in a case like this they are obligated to honor the price even if it was a mistake.

    When the package shows up, refuse it.

    Tell them that unless they refund you IN FULL (for "their" mistake), you will contact the FTC and a lawyer and sue them for bad faith, on the principal of the matter. In fact, don't just tell them on the phone, email them telling them that. Also, plaster it all over social media. Also, since you bought it off a Walmart website, contact Walmart and tell them what their partner-in-crime is up to.

    If they emailed you a correction you have proof they knew the ad/receipt was wrong. threaten to sue them if they do not pay all the charges since they did not give you "reasonable time" to see the email and notify them of your decision. Also complain to the "better business bureau" as companies are more likely to fix complaints that can be easily checked. Post complaint on web and only modify IF they fix the situation.
