I want to marry a Colombian woman who has a child from a previous relationship. Does the father of the child have to give permission?

Girlfriend has a child from her ex-boyfriend. Never got married. Father does not help with raising the child or provide financial support. Child does not have fathers last name (not sure of any of this matters)

I want to know if the father of the child needs to provide some type of permission for the child to move to the US?

Any advice? What are the basic slegal procedures to marry her.

    No you wouldn't need his permission to marry her. The only time he would have to be involved is if you decided to adopt her children.

    Your girlfriend needs to find all of that out. She can far more easily do so. Make it her responsibility and see how long it takes her to get it done. It's not up to you to find out what her ex's legal stances are. Just tell her to find out what's what.

    You marry her the same way you would marry someone without a child.

    Only if the father has a court order in place *preventing* the mother from taking the child out of the country would she not be able to. And given his lack of involvement, I'd wager that it's highly unlikely that he has any such order.
