I think you're right. But I cannot imagine a good teacher doing so and risking his/her job. I can, however, see students being ask to put their phones on the desk in a box during class.

If you or someone else are on thier phones during school, then yes they should take the phone away. Don't be on it if you do not want the teacher to take it.

Would you prefer to be expelled from the school / college for breaking the rules on phone use?
That's the only realistic alternative to the teachers confiscating phones.
You parents (or you, if over 18) signed a contract that states you will comply with the rules. If you break the rules, the teachers have the same authority over you and your property as your parents.

That includes the right to take things from you if you misbehave. As long as there is an intent to return them at some point in the future, whether end of the day or end of the school year, it's not theft and is totally legal.
If you don't like the punishment, don't do the crime!
