I have to pay rent again?

I just moved in on September 20th I paid 1400.00$ which was the rent , now the landlord is coming tomorrow for another 1400.00$ ? I haven’t even received a lease yet.  I’ve been asking him since I moved in for one . 

My heat doesn’t even work tried to turn it on this morning because it’s freezing and it doesn’t work.

    #1 if the heat does not work that dwelling is not legally habitable.

    What that means is there are laws that make it illegal for the landlord to rent that place out if it doesn't have a working heating system, running water, and electric that works.

    Are you positive it doesn't work or are you just not sure how to turn it on? Maybe the pilot light is out or something. Landlord legally needs to care for it. Which might just be showing you how to use it?

    Don't go blasting at the landlord. Give them benefit. Ask.

    2. You shouldn't have had to pay full rent for September. That should have been pro-rated meaning you should have only had to pay for the 20th until the end of the month. Not for the entire month. Not by law because you already paid it but by rights (the decent/right thing to do) is have it pro-rated and either have the balance refunded to you or applied to October's rent.

    September has 30 days in it so the daily rate is $46.67. You should have only had to pay $466.67 for the 10 days you were there for September. I'm not sure there's any laws that enforce and require pro-rating like that but it's usually how this stuff works and goes. This landlord is taking you for a ride (to his bank).

    He has to produce a lease. Especially if there has been no verbal agreement. If you've made a verbal agreement which can just be a conversation...you moved in, that's the agreement then. That's how any court will see it. If you ask for a lease in writing I'm also not positive that by law they have to produce one. They probably don't.

    He does have to get the heat working if it's truly not working. That is definitely law. You shouldn't be living there if it's not working.

    Me, personally, since there is no written lease you're on a month-to-month agreement by law and in most states (PA where I am for sure) that only requires a 10 day notice to move out. I would give him a verbal notice that I'm moving and start gettting my stuff out tomorrow. I'd be packing when he got there to hit him with the fact that he has to do me right or I'm outta there. A tenant can move immediately after giving notice, they don't have to wait until their notice to vacate expires to leave.

    Again: Be nice, mature, and calm about it. You get more bees with honey. But also stand your ground. September gets pro-rated, the balance applies to October's rent or is refunded (definitely refunded if you've decided to move - you need to find another place, quick!), 'please show me how this heat works. I tried to turn it on and it doesn't seem to be working.', and all you're responsible for for october's full rent if you're staying is another $466.67 since you already paid most of it.

    Don't let this guy take you...he's loving the fact that so far you've been a fool not knowing how this stuff is supposed to work and taking advantage of your lack of (experience?) knowing. He's trying to make himself a quick 2 week pay of over $1800 because of you not knowing. That's not a decent person.

    I suggest you get out of this situation. If he's trying this kind of thing now he's going to keep trying to do this kind of stuff. Not a landlord I would work with and rent off of. He's being a crook.

    If you haven’t received a signed (by both parties) lease, you should never have moved in.

    I would tell him he gets no more rent until yo7 receive the SIGNED lease. If he refuses, I would move out.

    Nobody can answer this for you because you left it so vague. Are you sure the $1400 wasn't a deposit? Did you get a receipt? If it was a deposit (or last month's rent) payable when you sign the lease, it's not odd at all he now wants first month's rent.

    I'm guessing, though. Read your lease and then talk to him if that doesn't answer your question. On the heat, have you told him it's not working? Really, you didn't give us much to work with here.

    It is now October, you need to pay rent. No lease is required. The rent for September should have been prorated.

    First time renter? That first $1400 likely wasn't rent, but a deposit. If the heat doesn't work you need to tell the landlord. Its best to have all communication with the landlord in writing (in case down the road you need to prove what was said to a third party … like a judge). Before you sign a lease, you should demand all repair be made, or make the demand part of the lease including what date the will all be completed.
