Yes. That is a malicious prosecution. Malicious prosecution is the same as a hate crime.

Check the six answers I've given the other five times you've asked this. Briefly, if part of a lawsuit is found to be UNTRUE, the rest of the lawsuit is NOT dismissed.
"A claim by the plaintiff" and "a story from the witness" are two different things.
In the vast majority of cases an attorney prepares the legal papers, not the plaintiff. Who knows what the plaintiff told his/her legal counsel.
Do you have some sort of disorder that causes you to repeat the same question over and over? If so, be prepared to lose in Court.
