Can you write a check from an empty bank account and get away with it? ?
I desperately need money. I want to overdraft by writing an empty check to myself. It makes me angry that my bank declines ATM overdrafts. I bet I can overdraft by writing a check to myself. If the bank bounces the check, is there a chance I'll go to jail? I want to write myself $500. What would happen if its declined? Will the bank also close my account?

That's a CRIMINAL offense, called FRAUD. You can get YEARS in prison for that.

First, the bank will not cash the check. They can see that there's no money in the account, and they will reject the check.
Then they will charge you a fine for writing a bad check. That will make your balance negative so they will charge you an overdraft fee.
It is fraud to knowingly write a check for more than is in your account. If the bank can tell you did this on purpose (which would be obvious if you do it the way you described), then yes they will close your account, and you might be arrested.

It's a criminal offense to write checks on accounts that have insufficient funds. Generally, you'll be arrested and your name will be published in the local newspaper stating you were arrested for this and you'll also have to appear in court and face imprisonment. The bank will close your account and you'll have great difficulty opening another in any bank.

So you want to simply write yourself a check and you don't KNOW what will happen to you if you do? Are you a moron? NO. The answer is NO. Period. Yes, you CAN go to jail--if the bank decides to pursue a charge against you. YES you CAN have your bank account closed. Yes you WILL be charged with a crime. It's THEFT. And FRAUD. Honestly--I can't believe you are that dumb.

You cannot get away with it. If you don't pay back the money, then in addition to closing your account, they will also report you to CheckSystems, so you won't be able to get an account anywhere else. And there is a chance that you might go to jail.
