help with a paypal dispute ?

Paypal closed a dispute in my favor after the seller failed to respond. As a result when the dispute closed I was given a full refund and never instructed to take further action such as return the item.

Well now two weeks later the seller says he never saw the claim because he didn't check his email and he wants the item back.

The purchase was made through a third party site like ebay for electronics (swappa). Do I have to return the laptop even though the claim was already closed. Shouldn't they take it up with paypal instead.I don't want to pay the shipping and insurance cost to send back the item when the onus of keeping up with sell they made was on them.

They will provide to you a free shipping label and free insurance. You knew when you filed the PayPal claim that there was something wrong with the laptop otherwise you wouldn't have filed the claim you knew the procedure on eBay it's very clear you open a case you asked for a return label and then you return the laptop.

If after they make a claim for you to return the laptop and provide to you a shipping label with insurance that you failed to do so you're considered by the law to have committed fraud. You kept something without paying for it. And you made no offer or attempt to return it and you received money that's all the law cares about that's enough for them to send them right to your door and slap the cuffs on you and they won't think twice about doing it.

You got your money and if you now have a request to return the laptop you have to comply with that request you don't have to pay for shipping or insurance that's their obligation!

there's probably already a return label waiting for you in the resolution center!
