Mortgage company has change of heart and contract?
I have a home that WAS paid for. Since my husband and I have an empty nest, my health is deteriorating rather quickly and I have been on disability, we decided to take out a loan on our home, purchase a motorhome and just rent our home out as this was going to be the MAIN way of paying the mortgage payments. This was explained in length to the lender approximately one year ago. We got the loan, bought a motorhome and drove over 2000 miles back home. We received our "mortgage papers" in the mail while we were gone. As I read some of the "fine print" it said that our home HAD to be "OWNER OCCUPIED" (and they would at times come to inspect the property AND owner occupation)... Now that it has been a little over a year and we found ourselves stuck without being able to "rent out", we are 4 months behind on our payments (& cannot get the mortgage company to return calls to take advantage or the home retention program...phone tag) yet when I called and spoke to "someone" in the collection department and told him of our situation and how we had "planned" all of this out, the gentleman put me on hold for a few minutes, came back and said that he DID NOT see anywhere in the contract that we COULD NOT rent the home out! We have been making payments for almost a year and NOW they change the contract and that is exactly what put us behind in the first place...Where do I legally stand as to this "change of heart/contract" with this mortgage company as I do not know what they are going to do?

I'm on disablity. I have been told by 3 doctor's that I may have MS. My memory has really gotten bad lately, especially when paying bills on time. My husband went down to the water company to pay to get water turned back on. The service is still under my former married name from when I bought my house. They asked for his drivers license, pulled up his account & told him he would have to sign a paper before they would turn our water back on & said he owed $117.42 from before we got married. They added his bill to mine as an "adjustment" & now I owe $227.80. They gave hin no choice but to sign a paper in which he has no idea what was on it & they didn't give him a copy either. Seems like extortion to me. I requested them to send a seperate Itemized billing along with a copy of what he HAD to sign for service to be restored (?) but actually I am almost certain I paid it (along with some other bills) but I have to look up my 2001 bank records to find proof. Is this legal? Alabama.

Ex-husband died 2000. My name still on business property. Original deed had "both of our concurrent lives". My property settlement/alimony in gross balance was $134K. 1997 divorce atty didn't "secure lien" as ordered & my claim denied. My x-atty kept me in the dark on all matters and lied to me. Said he filed an appeal.He DIDNT.Iit was a "motion to establish a lien". NO APPEAL! Will not send copies of files & claims "some" were damaged in Katrina (not in lower Ala.!) Now? I saw online that probate ordered quit claim deeds to be signed (Jan.14th '02). Not only were they handed in at that moment, my sig was on them BUT I DID NOT SIGN THEM! The QCD's were prepared by "estate" attys. My x-atty's secr.notarized them with an "invalid notary sig." they were dated Dec.4th, '01, well before the judge ordered them.1 atty stole ex's will & claimed didn't have one. BUT! his former fiance' was with him when he signed. She was MAD because me & 2 sons to be well taken care of. $2.6MIL assets gone.

I do know that the "higher" court decisions takes precedence over the lower ones yet a probate judge threw out my claim against the estate of my ex-husband which was in the circuit court "property settlement / alimony in gross. The judge didn't even notice that 2 "quit claim deeds" were forged and manipulated. I am out $134,000.00 and an extremely valuable piece of commercial property. (I have my former attorney to blame and file suit against) but what about the judge?

I have been in search of an attorney that handles legal malpractice cases in Alabama. Even if they practice out of state and licensed in Alabama. Since this is a "high-profile" with multiple charges case it seems no one wants to take it. As of now I am sending all the info to the attorney generals office, local and state. They have already told me I have grounds to file suit and also for civil and criminal charges. The lawyer referral services have sent me to attorneys that are not willing to take this case. Anyone have any ideas or referrals? I would appreciate any help. I have already been through all the resources available on the internet (I think?) The local and state bar, you name it... If you are an attorney I would not take it as a "solicitation" if you would contact me via reply post.
