  • Does this constitute trademark infringement?

    Hypothetically, let's say I own a fully registered trademark (for going on 3 years) to the name "Man Band".

    Now let's say another band has started using a similar name (within the past year) of "The Man and The Band".

    Granted these names are not identical, they have now created a real confusion between the two amongst search results. since the word "the" is ignored in nearly every online search query, and the word "and" serves as a logical operator, joining "Man" and "Band" together, it will always be the case that a search for "Man Band" will return equal results for both. And vice-versa.

    Considering we both operate in the same realm (both music groups) providing the same type of product, do you think there's a case for trademark infringement here?
