  • personal property split in divorce?

    A good friend is having problems regarding personal properties during/after divorce.

    1. In negotiation right now. Soon-to-be ex claimed she wanted certain items in the house, like a small box with petty contents from her sister's dead friend. My friend said he'd never seen those things in his life! What is the right way to deal with this type of false claims? The ex does have mental issues and goes to a shrink often.

    2. Is there a way of avoiding meeting the ex when she comes to get her share of personal properties after the divorce is finalized? My friend is certain she will try to cause commotion (she once called the police claiming my friend hit her. Luckily there was a witness). He is thinking to put all her stuff in the garage and ask a third party(a friend or a neighbor) be there to represent him while she moves stuff. Is it better if he rents a storage unit for 30 days, put her stuff there and then deliver the key to her lawyer? Does anyone who has had divorce experience have a better way to do this asset disposition? Or should my friend just have to face his fear and consider it the last step before his final freedom from the lunatic?

    He really worries she would go on and on and on about petty items missing which are pure in her imagination.

    Any help is appreciated.

    My spouse and I separated in September, 2011. Our divorce was not finalized by 12/31/11 so by law we are considered Married for 2011 tax return. We would benefit if we use Married file jointly, but my spouse refuse to do so out of spite. I would get less deduction by filing separately and I guess she will get more since she didn't work in 2011 and I provided all the money for our living expense during the marriage and also after we separated. Does anyone know what is the rule/law on how to decide filing status when a divorcing couple cannot reach an agreement? We live in Kansas.

    My second question is if I have to file as Married file separately, I would be better off using itemized. I heard both parties have to use the same method in Married file separately. What is the rule if my spouse wants to use Standard deduction?

  • Who is the authority to dispute a doctor charge?

    Hi,

    My doctor charged me for an annual exam which should be covered under my insurance. The insurance rejected their claim because they coded the claim wrongly as an office visit. My high deductible insurance plan doesn't cover office visits until it goes beyond $3,000. I told the doctor's office to change the code to Annual Exam and resubmit the claim. They wouldn't. They said to change the claim they had to provide proof to the insurance company, but there were some errors in their record about my visit and they couldn't provide the proof. Well, that's not my fault so I refused to pay. Now they turned me to a collection agency. I wrote the agency a letter, but they said they had nothing to do with this and either the doctor withdraws the request or the agency submits a delinquency report to damage my credit history. I don't know what kind of collection agency they are. Seems to me they are hired just to notify me that they will report me to the credit bureaus. Anyway, that's not my question. My question is who is the authority for consumers to go to for this type of dispute. I know the 3 credit bureaus are there so the consumers would pay their bills on time. There ought to be some authority there to regulate businesses and protect consumers.

    I'm very frustrated. Every friend I talked to said that was so wrong for the doctor's office to force me to shoulder their cost caused by their errors. However, no one knows who I should go to to protect my rights.

    By the way, the collection agency said it had been more than 12 months since my visit to the doctor and the insurance claim period had probably passed. The doctor won't get paid by the insurance company if they resubmit the claim now.

  • How different debts affect credit scores?

    Do mortgages and auto loans affect our credit scores the same way as credit card debts? I think they should have less negative impact since they are collateralized by the house or the car. If I'm right, that means if I get the same interest rate for an auto loan as for borrowing from a credit card when buying a car, I should go for an auto loan, right?     Is it correct to say that if you are incurring a capital loss on stocks, you're always better off to make it a short term loss for tax purpose? My reason is short term GAIN carries a higher tax rate and you always want to offset this gain first. Short term LOSS will offset short term gain first. Long term loss, however, will be used to offset long term gain first, and that leaves you to pay a higher tax rate on your short term gain unless your long term loss is big enough to offset all your short-term gain.

  • credit card closed by credit card company while I am always in good standing?

    I have borrowings from 2 credit cards. Not that I really need the money, I just take advantage of the promotional 0% APR and deposit the borrowed money to earn some interest. I always make the minimum payments on time and meet all requirements. Today I suddenly got a letter from the credit company which I have less outstanding with, saying that they have closed my card because the proportion of balances to credit limits is too high.   • EXCEL filter question?

    For a sheet with multi-column data. Some rows have the same value in column "Company Name". I want to delete redundent rows so each row has a unique "Company name". I can't use advanced filter -- unique record because the rows with the same Company Name do have different values in other columns. Since the rows are not absolutely the same, EXCEL treats them as different records and doesn't filter them out.

    I don't know how to use Macro. What should I do? Can I put criteria in advanced filter to solve the problem? if so, what criteria should I put in? Thank you!
