  • I have a question regarding HIPAA laws?

Not to go into too much detail but our family has had a problem with an employee at our local hospital. This person is on the Risk Management team which gives them access to personal medical records. Our hospital is also connected to the majority of the doctors in our area because the hospital pretty much owns all the practices. So the entire computer system is linked. I filed a complaint on this employee for harassment and I also stressed my concerns that this person has access to my families medical records. The hospital has not acknowledged my complaint so I also contacted the CEO. The CEO did get back with me and said that he would contact HR to see what actions are being taken but I have yet to hear back from him either. I would think that the hospital would need all over our information including our children so that they could access the system to see if this person has logged into any of our files. I was told they are only allowed to access files on a "need to know" basis (working on a case).

My question is this: If they do not investigate it, what should I do? I don't know much about HIPAA, and I don't know for sure that it has been violated.

  • Nice family beaches in Massachusetts?

We are new to Massachusetts and are looking for some nice family beaches. We have been to Horse Neck but the rocks were horrible. By time you got through them to enjoy the ocean your feet were killing you. Are there any other beaches within about an hours drive from Boston that have nice sandy beaches??

  • Can our lease be broken? Living in Massachusetts?

We just recently moved to Massachusetts and are renting a house. We are having major problems with out landlord fixing things. This winter we had ice dams which forced water in through the upstairs windows and traveled down inside the walls to the downstairs windows. My concern # 1 Mold. 2nd she filed a claim with her insurance co to pay for the damages. The adjuster told us the windows needed to be scraped and repainted along with the walls, carpets cleaned and then other outside repairs. This has been well over a month and she has not had anyone come do the work. My concern #2 MOLD and the fact that this house was built in 1870 and I'm sure has lead paint. This leads to another issue...we were never given a lead based paint disclousure and from what I understand it is a Mass. law for rentals to provide it. We now have fungus growing in the basement along with mold. I have contacted her regarding the mold and she has no concern for our health, so I contacted the local health dept and they will be coming to inspect the property. The landlord didnt even have smoke/fire detectors in the house, we had to go and buy them. We were promised the garage and she never moved her stuff out as promised. Fall clean up has yet to be done, which she promised. So are there grounds enough for us to with hold rent? Break lease and move?

  • My daughter was diagnosed with absence seizures at 13 now they are worse at 18?

I've been trying to look up information about the different kinds of seizures and trying to pin point what kind my daughter is having. She has to see her neurologist again, but does anyone know anything about them? Episode today: Was standing holding a puppy and both arms shot out and she dropped the pup. She picked the pup up again and it happened again but we caught it. We had her sit down and she had jerking in her legs. No loss of conscientiousness but she looked disoriented. Then we got her up and 4 times her legs went and she collapsed on the ground. Again the look on her face was like she didn't realize what happened. On the way to the ER she had arm tremors again and this time she started stuttering and was mixing her words and couldn't use the right words. Anyone have anything similar that might give us an idea? Just wanting some possible answers before her appointment. She also gets a headache in the front part of her head.

  • We have a medical bill for services we did not accept now being sued?

In November 2006 I had to have knee surgery. The day we scheduled the surgery the office told us that they would be putting a Cryo Cuff on my knee after surgery, but we had the option to decline it since most insurance companies would not cover it. She told us to call our insurance and find out, then we could decline it the day of surgery if not covered. I called the insurance company and they would not cover it. The day of surgery when I checked in I told the check in receptionist that we did not want the device. She said ok and we thought that was it. While in recovery I had a blanket on and when they went to put me in a wheel chair to go home my husband saw the device and told the nurse we already said we didn't want it. The nurse said well it's already on her. In the mean time the supply company filed a claim several times with our insurance and it was denied each time. In the first week of March 2009 I finally received a bill and I wrote them a letter (which I still have) stating the facts that we did not want the device. I have never heard from them until we received a summons on our door to go to court for this bill last week. What started out as $430 is now over $1,000. Anyone have any suggestions on how to fight this? My husband and I will probably be the only wittnesses against the attorney to the facts.

  • My husband switched jobs almost 2 years ago. Last job didn't pay expenses incurred on business card?

We had a company credit card and when my husband switched jobs they did not pay his last expenses billed to it. The bill is around $2600 and all but about $800.00 was company expenses. Now we have a collection agency coming after us for the total balance. My husband and I have requested itemized bills but they are refusing to produce them. We want to pay what we owe, but can't without the itemized bill. AE has closed our account so we can not view it or pull the statements for ourselves. The collection agency I thought had a duty to show proof of bill. We are not the first ones that his company did this to. Seems like if you quit they don't pay the last expenses. Any suggestions?

  • We recently had a health claim denied even with confirmation number and a letter of benefits?

Recently my husband had to have a sleep study done. The Sleep Center and the Home Health Care supplier contacted the insurance company to find out benefits. The Health Care Supplier received a letter of benefits and a confirmation number to supply my husband with a BI-pap machine. They have now denied to claim stating that the confirmation number was not submitted with the claim. The billing office submitted the claim electronically and some where along the lines the confirmation number did not make it. What recourse do we have? They (the insurance company) are saying it's a done deal which I thought there was an appeal process? I thought if information was missing they normally requested it before they denied it?

  • Is there negligence if there is a car accident and the driver was under probationary license?

In february my daughter stayed the night with a friend. Her friend had to take some stuff to someones house and the parents allowed my daughter to go with her. On the way back a deer bolted out in front of them and they swerved and struck a tree at 50 mps impacting on my daughter side of the car. My daughter sustained back (2 bulging disk and soft tissue), neck injuries (soft tissue damage) and multiple bruises and lacerations to her legs. The insurance company says there was no negligence since it was a deer. The one thing I question is the fact that the driver was in her 90 days probation license. In Indiana no one under the age of 18 can ride with someone on their probation license for 90 days without an adult present. Would this be considered negligence? Her bills are up to $22,000 and the insurance says they will only pay up to $25,000 medical and no pain and suffering. If it goes beyond $25,000 then we have to file a bodily injury claim and only then will it pay pain and suffering.

  • ABS and ESP lights are coming on when braking. 2007 Jeep Commander?

I looked up recalls due to our 2007 Jeep's ABS and ESP lights coming on while braking. The ABS is engaging because you can hear the grinding in the brakes. I found recalls on the 2007 Jeep Commander with this problem. I called a Chrysler Service department. He looked up our VIN number and found no recalls for ours. Does anyone have any ideas what this could be? Or what I should do? The brakes work just fine 80% of the time, it comes in cycles with the light coming on and the brakes grinding. Happens on dry roads.

  • Is it more economical to run your natural gas log fireplace and keep your furnace temperature set lower?

If we run the gas logs on low and keep ceiling fans on it keeps the furnace from running as much. So is this an economical way to heat your house rather then running your furnace all the time?

  • Have a Saab 93 2003 with immobilizer problem?

We have immobilizer failure which we know how to rewire to disengage but the only problem is we can't find where it's located in the car. All diagrams show it under the drivers seat, under the carpet by the vent. We took the seat out and it's not there. Anyone have any ideas where it is located? Of course the dealership won't tell you because they want all your money to fix it.

Since all the changes on security I have a question. I know that after I go through security I will have to purchase bottled water from a vendor to make bottles.
