Hello, I was arrested in MN with like 40g of marijuana and a scale, they charged me with a FELONY and now I'm on probation for 5 years, BUT I was looking through MN's Marijuana Laws and found that I should've only gotten a Misdemeanor! Oh, and this is my first conviction ever.

My official charge is -

Possess/Sale Small Amount of Marijuana with No Remuneration - Felony

according to MN Law -

Distribution of 42.5 g or less without remuneration - Misdemeanor

Even though court for this is over, can I challenge it nonetheless and get the sentence that I'm entitled too?

Seriously. I see so many people with scar tissue exploding out of the back of their lobes because they wanted to stretch to 00g over the summer. When are they going to learn that this is a delicate process that takes patience if you want respectable looking ears? And why are they so infatuated with who has the largest size? Comparing theirs to each others every second they get? It's sickening.

I was put on probation May '09 for Felony marijuana charges. My lawyer and I plea bargained for some statute and I was given 5 years "telephone reporting" (I call a number and answer questions for a machine) with the option of early termination for good behavior. Since I don't have to take UA's, I still smoke. I was in a grocery store and grabbed some pieces of candy from out of the bins they have. That led to having the cops called, who found a small ball of resin in my pocket, and a paperclip with resin on it.

I received a ticket for -

Theft Shoplifting ($0.63)

Possession of Small Amount of Marijuana

Possession of Drug Paraphernalia

I haven't done any of my CS or paid any fines. I don't have a violation hearing yet because I have yet to call. I'm going to deal with this head on, and want some advice. Serious answers only, don't just answer so you can get points.
