former employee suing union due to breach of duty of fair representation. Union members decided to take a majority vote to not go through with grievence for this individual. They got it- now employee is suing. If a union member was in the minority- and voted for that employee to be able to go forward with his grievence- and if employee wins this suit- which will pretty much wipe out union monies- can the union member who supported the grievence protect his union money from the lawsuit?

Can local law enforcement use a court order signed by a judge from the court of common pleas to obtain a possible defendants bank records for a criminal investigation or do they need a subpoena? What is the difference between a court order and a subpoena in PA, and which has more power? Charges have not been filed against the suspect yet. Can you cite case law or PA statute that supports your answer? Thanks so much- school project!

Hi- my son is in 3rd grade he is 8 yrs 4mo old. I have had reservations about pushing him forward ever since kindergarten. He went into Kindergarten with out the ability to read when most other kids were already reading. The school insisted that he would be fine. Each year I noticed he was a little behind some of the other students. I wanted to hold him back but the school said he would be fine, they provided Title I math and reading and he was evaluated at the end of 1st grade and according to the school psychologist he scored well enough to not be thought of as learning disabled. Every year they insisted he move forward even though I thought he should be held back. Now in 3rd grade he is behind. The school tells me that his records reflect that he would be doing excellent if he were in 2nd grade but some of the 3rd grade work is too hard for him. Now they want to evaluate him and have him labled as learning disabled!! My son is a shy sweet little guy he gets home sick sometimes but he excells at home in everything. I think he should try 2nd grade over- I do not want him pushed through the system with special ed when I do not think he is learning disabled. Should I let them test? What are my rights in PA as a parent and independent testing, and does anyone know an independent psychoeducational evaluator in PA? Sorry this is so long but I am so upset over this. Thank you!

I understand that Identity Theft in PA can be procecuted in either the jurisdiction of the victim, the defendant or where the theft took place. Does this also hold true for other theft offenses? Example: Theft takes place from bank account of victim with main branch of bank being located in one county, victim lives in another county as does the defendant. When it was time for my son to enter kindergarten, school personnel questioned his readiness but welcomed him. His kindergarten teacher stated that he was a little behind the other children, but had no reservations about promoting him to the 1st grade. She stated that he could be placed in a smaller class as to allow for more attention. Now that he is in first grade his teacher is concerned that he may have developmental delays, and they want to have him tested. His grades are good and he does beautiful work at home. His school papers tell another story though (sloppy, incorrect). He is in a class with several autistic children as well as children with behavioral problems ( I have met with their parents). My son comes home and tells me he is distracted by the other children's outbursts (biting, screaming, talking, tapping on his desk). My question is this- could this be environmental instead of a developmental delay? He never showed any delays in the past.

My mom went into the hospital last Fri. Her symptoms were jaundice, stomach and back pain and very dark urine. She was found to have stones in her gallbladder. It was also thought that she may have a stone blocking a duct. After testing there was no stone but suspicious narrowing of the bile duct leading out of the liver. A stint was placed, but Doc's are worried because her levels (I believe of billirubin) are not coming down as quickly as they would like. She had a scope procedure during which they took a "brushing" of the inside of the duct. Doc's have not gotten the result of that test yet. We are concerned because the Doc suggested that my mother go to the Univ. of Philly for further testing. We are in Scranton PA. Docs say that it is not Sclerosing Cholangitis, but they are trying to rule out cancer. Any opinions out there? We are so worried. My mom is 67. Could anything else cause this blockage or narrowing?

Is there a way in PA to find out if someone applied for workers compensation? Ex husband got a new job, worked a few days and "hurt" his ankle. May try to qualify for workers comp. He is way behind on child support and has not reported this new job or injury to domestic relations.
