  • How long can I avoid the process server?

    The lender is trying to serve me a Writ of Possession for a vehicle they have been trying to repo since 2009. The process server has come by 11 times that I know of, and I've been successful at avoiding service each time. I stay in the house and act like I'm not home. I don't answer my door for anyone, and only run errands at night. I look both way carefully and get in and out of the car as fast as possible when I come and go. They only know that I'm listed as the property owner. They don't know for sure that I'm actually living here. I ran my credit report, and the original lender sold off the loan in early 2010. My credit shows all current payments for 2010 and 2011, and I haven't made a single payment! it seems like its helping my credit score to drag this out, hide the car, and avoid the process server for as long as I can. I understand that if they fail to recover the car, eventually the lender can sue me for the entire balance of the loan, regardless of whether they repo it or not. What if they never serve me? I understand they cant show up at a relatives house and give them papers to give to me, and they have to personally hand the papers to me. They cant just put them in the mailbox and say I got them. if they try that, whats the best way to "challenge service?"

    I havent made a payment since July 2009. The "bank" has gone to court and been issued a Writ of Possession. They havent shown up to my house yet. I hear that they'll come with the police and repo guy. I plan to hide out in the house and not answer my door. The longer I string them along/stall for time, the longer I go judgement free. I figure if they get the vehicle back sooner, they'll sue me that much sooner and start garnishing my wages. Seems to be to my advantage to string this out as long as possible. What happens if they never recover the vehicle? (its in Mexico)

    Why would I surrender the vehicle? so they can auction it off for pennies on the dollar, then sue me for the balance? ohhhhhh, and garnish my wages. forget that, I'll part this sucker out and give it back on blocks, lol

    Is it possible to beat the repo man? I'd have to say yes. I've beat the repo man like a "yard dog" for the last 2 years, lol. Even if they sue me and get a judgment for the full balance of the loan, plus repo charges, they'll never recover the vehicle and I'll declare chapter 7 bankruptcy and wipe out their judgment. I think its funny as hell to see "The Bank" continue to switch repo companies. They've burned through 3 different companies in the last 2 years. I think its funny to confuse their "skip tracing" software, by registering my credit cards to a relatives house 2,000 miles away. Also, turing on utilities for a buddy who is attending college out of state confuses them as well. The more time they waste with me, is one more day someone else more deserving gets to keep their car, because the repo guy is spinning his wheels with me. I cant wait until he shows up with the cops. I will come out, get really really really mad, tell them the vehicle "ain't here" so "get lost." I will also trespass the repo guy in the presence of the officer, and is he returns, it will be considered "disturbing the peace" which is a big No No in the repo world. The cops can only arrest me if the vehicle is here

    Ok this is the deal. I have a 2004 F-350 Truck. It has been out for repo for 3 years. These guys cannot find my truck. I register it every year and its Fully insured. The bank has written it off and I have moved to a different city 120 miles away. I have not applied for any credit and all my utilities are in my girlfriends name. So they cannot trace me. Every now and then they pass my parents house as they tells me a tow truck came creeping by the house and I know they have spotters as well as contacting some of my parents neighbors and tried to bribe them with a finder fee. If you leave no paper trail and dont need to apply for credit but if you do you should use your old address not your new one. Dont get anything in your name on credit or utilities. If your lucky like me have your apt and everything in your other halfs name. After three years you would think they would stop but like I said im 120 miles away and I dont go visit my parents in my truck. I use another car. So see the repo guys arent as smart as you all think. Also dont let them scare you with your going to jail if we dont get the car. Its a Civil matter and no one in California has been thrown in jail for that. Yes they can sue you for the money or get a court order if your hiding it in the garage but remember they need proof. (Plus your not hiding it if you moved to a new addy) So becareful they have spotters out there taking photographs. Plus When you have had a friend in the repo business it help to know the tricks they use. Alot of Scare tactics!! There is always someone more smarter. Maybe I will get found but after 3 years. Nothing. AND MY TRUCK IS LEGAL. Registration and insurance. Its registerd at my old addy. I go to the dmv and register it in person every year with no problems.

    There is always one they cannot get. That is me Ha ha.

  • beating the repo guys at their own game?

    I stopped making my car payments in July 2009. I sold ALL the parts and cut up the frame. The car doesn't exist any longer, and can't be surrendered for repo. what happens if they never repo the car (because it doesn't exist anymore) and can't prove I sold the parts? (even if they could prove I sold the parts, its not a crime because I am the owner and the bank is just the lien holder)

    I thought my car was repoed last Dec. I was 4 months behind on the payments. the repo guys came several times... then the car disappeared, so I assumed they took it. I didn't hear anything from the repo guys/bank until last week ( a year later.) The Finance Company got the court to issue a "writ of possession" and they left some kind of notice at a family members house, while he was at work. It says something about the sheriff's office on it. I think these guys are coming to my house next. the writ of possession had my company listed as the defendant, my name wasn't on it anywhere. I know I can stay in the house and not deal with these guys, even if the cops are out there, because this is a civil matter... not like they can kick my door in and drag me out. My problem is I have no idea where the car is, figured they repoed it a year ago, so I canceled my insurance and registration right after the car disappeared, I also ran my credit report in Jan, and the car loan showed "Paid and closed" so I had no reason to think anything other than the bank repoed the car... what happens from here? what do I do? I lawyered up, and told those guys I dont have the car... will they just go away, then sue me for the full balance due? Can I go BK on their judgement?

    a guy to remain nameless stopped making payment in June 2009. Car was stripped down to the frame, everything of value sold off for personal benifit/gain "from his car" (bank is just a lien holder)... frame was cut up into small pcs and disposed of in multiple locations. car never recovered. what happens to the owner if he has "no clue" what happened to the car and they cant prove he "does have a clue?"

    can he bankrupt on the judgement that the bank is almost certain to get? It would only be "fraud" if the bank can prove he personally benifited from the sale of the car parts, correct? (or prove that parts were even sold) As long as he doesnt file a police report or insurance claim, theres no crime, correct? Car is not stolen, because HE owns the car, selling parts from HIS car, not the banks car. The bank is simply a lien holder, not "owner," so they cant report it stolen. all they can do is sue. He would be the only person who could report it stolen, and he would have to file the report against himself, correct? and no resasonable person would file against themself... this is CIVIL, not criminal

    I haven't made a payment since June 2009. They stopped trying to repo it in Nov 2009. A guy showed up in June 2010 asking questions, but I haven't heard anything since. I don't have the car and have no idea what happened to it. A lawyer told me I dont have to answer my door or talk to the repo guy. I have no plans to cooperate at all. The vehicle was not insured or registered, so I have no reason to file a police report since there was no insurance. If they sue me and a judge gives them a "writ of repleven" I cant turn over what I don't have in my possession, and I have no clue where the car is, so I'm home free, correct? All they can do is sue me for the full loan amount and get a judgment against me? At this point, I am pretty much lying low and buying time until I can go Chapter 7 BK and wipe out all my bills and start over... I got one of those "Cash Only" Go Phones and registered it to the name "Barney the Cat" lol... I pay in cash, so no more harassing calls. I don't answer my door, and I send cease and desist letters back to the bill collectors when they send me mail. I want to pay my bills, but simply put, I cant right now. Whats the best way to avoid the repo guy/bank until I can save enough cash to go BK?

  • Is it illegal to steal your own car back from the repo lot?

    My car was repossessed. I have the money to to pay to get it back, but the bank is dragging its feet about giving the absolute grand total. I asked the guy at the repo yard today and he said it was already scheduled for auction. I am a relatively resourceful individual. I know they have not re-keyed the car as I gave them my key. I have done recon on the location and found it possible to do a midnight grab and escape. Is that illegal. I mean, it is my car and they don't seem to want my money. I would ultimately resolve the issue with the bank, I just don't want them to send it to auction first.

    The repo guy came over, ringing my doorbell, flashing some kind of badge, like he was a cop. The next time he does this, can I stall for time and call 911, telling the cops I think he's trying to break into my house and there's an unknown male on my porch, that I'm armed and may have to shoot? they will come blue lighted, armed response, correct? scare the **** out of the repo guy, lol

    Financed a car in June 2006. Stopped paying on it in Sep 2009. Repo Guys and bank stopped all contact in Dec 2009... shows "Paid and Closed" on my credit report. Well some dude showed up today claiming to be from a "investigation" company... of course I played dumb and told the dude I had no idea what was going on and I claimed I just rented the house and he must be looking for the owner... What happens if I ignore these guys again, don't answer phone calls or talk to them, and when they sue eventually, don't show up to court? I've been selling as many parts as I can off the car, it doesn't even drive... so when/if they happen to find it, will need a flatbed truck to move it. Is it better to give it back missing all the parts, or just make it "disappear"?
