  • How can i offer still copyrighted material?

    Is it illegal to advertise and take orders for sheet music that is still under copyright protection in another country (i.e. USA) on a server that is located in that country? The works don’t reside on that server (i.e. as downloads) and are printed and shipped from Canada where they are already in the public domain. That the printing and shipping from Canada is legal I already established, we just have to know if the servers (web server, etc.) also have to be physically located on Canadian soil or if information about the material can also be hosted outside Canada (i.e in the U.S.). Since there is no copyrighted material being distributed from a web server residing in the U.S. it should be OK, but please correct me if i am wrong. The reason for this question is that there are no good hosted web shops available from Canadian ISP's, so i would have to opt for a hosting provider in the U.S.

  • Is there a way to obtain the copyright to an existing piece by adding instrumentation to it?

    - "Beethoven's Symphony No.2" is in public domain. If I'd make a corrected version o the original score, I'd hold copyright status of my revision. If I hold copyright of this revision, does it mean I would be able to receive royalties for the performances of those using my score? Or would I have to make a significant arrangement to be able to count as a distinct work?

    - What's the difference on copyright status for unchanged-revisions and significant arrangements of music of the same score?

    - If a score is in public domain in country A, but not in country B, can it be sold in both countries? E.g. When a passenger comes back from a different country, he is responsible for the items he brought from that country (that while might be legal there; they might be illegal in the country of arrival). Does this same concept apply to sheet music?

    - If a score is in public domain in country A but not in country B and significant arrangement of this score is made in country A, can it be sold in country B (since it's not the same as the original)?

    - there is a score of a Symphony, that while in public domain, it isn't widely spread. If my revision is the only available (and let's just consider that whoever plays it, uses my score), am I entitled to royalties?

    - Kalmus is a major sheet music publisher, and they have in their FAQ this statement: " Almost all of our products may be ordered for shipping anywhere in the world. However, please note that it is ultimately the responsibility of the customer to ensure that any items they import are in compliance with the laws of their own country." is this protection legal?

    - Sometimes sheet music books have legal notices such as: "To photocopy or reproduce by any method is an infringement of the Copyright Law", the book was published in the USA. However, it's also said that teachers can make some copies of a book for their students, libraries can also allow it if they own a copy of the book. Does this make the statement on the book invalid and just an attempt by the publisher to scare their customers? That same statement says that reproducing by any method is an infringement. But playing that music on an instrument, would be reproducing what's written, therefore being illegal?

    - I have perfect pitch (means that I can detect all the notes I hear). If I listen to Lady Gaga on the radio, is it illegal to write it down on paper? Could I sell that piece of paper?

    - Can I make a minor edition (with few/no changes) of a copyrighted work (without asking the copyright holder for permission)? Can I make a significant arrangement of a copyrighted work (without asking the copyright holder for permission)? Would I be able to sell that work? Would I be able to sell it in the country where the copyright holder is registered? Could I claim royalties on the performances of my arrangement? What would be the connection between me and the original copyright holder?

    - People post their interpretations of songs on YouTube, without paying any fees to the copyright holders or YouTube, however they can generate income with that (gigs, ads, banners, advertisement in general). Is that legal? If it is, how?

    Beethoven’s zweite Synphony ist urheberrechtlich nicht mehr geschützt. Wenn man eine Transcription machen würde und diese Transcription würde von einem Orchester gespielt, wäre ich dann berechtigt dafür Gebühren zu verlangen? Wie signifikant müssen die Änderungen in der Transkription sein?

    Worin bestehen die urheberrechtlichen Unterschiede zwischen dem Orginal, einer Revision und signifikaten Änderungen an einem Werk?

    Wenn ein Werk urheberrechtlich in Land A nicht mehr aber in Land B immer noch geschützt ist, kann es dann in beiden Ländern verkauft werden? Kann es z.B. von Land A nach Land B verkauft werden? Wenn ein Käufer es in Land A kauft und in sein Heimatland (B) zurückkehrt, ist er dann für die urheberrechtliche Situation des eingeführten Werkes selber verantwortlich?

    Wenn ein Werk urheberrechtlich in Land A nicht mehr, aber in Land B immer noch geschützt ist, und signifikante Änderungen an dem Werk in Land A gemacht wurden, ist die urheberrechtliche Einwandfreiheit des Werkes in Land B gesichert?

    Wenn ein Werk nicht das mehr urheberrechtlich geschützt ist mit den hinzugefügten signifikante Änderungen aufgeführt wird, ist der Revisionist berechtigt Gebühren dafür zu verlangen?

    Kalmus, ein grösserer Verleger, überträgt in seinen allgemeinen Geschäftsbedingungen die Verantwortung der Einwandfreiheit der Urheberrechtssituation auf den Käufer des Werkes. Ist dies mit internationalem Recht vereinbar? Hier der entsprechende Auszug der allg. Geschäftsbedingungen von Kalmus: „Almost all of our products may be ordered for shipping anywhere in the world.     Wenn jemand die in Notenblättern abgedruckte oder einer Webseite angezeigte Musik aufführt, wer ist dann für die Einhaltung des Urheberrechts verantwortlich? Der Verleger/Webseitenbetreiber, oder der der die Musik aufführt?

    Kann man Änderungen an einem urheberrechtlich geschützten Werk machen ohne den Inhaber des Urheberrechts vorher um Erlaubnis zu fragen? Einige Werke beinhalten von einem musikalischen Standpunkt aus, Fehler. Wenn man diese Fehler, auch bei einem urheberrechtlich geschützten Werk behebt, kann man das Werk dann auch verkaufen? Dürfte man es auch in dem Land verkaufen in dem der Inhaber des Urheberrechts registriert ist? Was wäre dann das Verhältniss zwischen dem Revisionist und dem Inhaber des Urheberrechts?

    Viele Internet User publizieren ihre Interpretationen eines Werkes auf YouTube oder ähnlichen Webseiten ohne dafür Gebühren an den Urheberrechteinhaber abzutreten. Die hostende Webseite generiert aus diesen Publikationen Einkommen durch Werbung (z.B. Banner, etc.). Ist das legal, und wenn ja, warum ist es legal und keine Verletzung des Urheberrechts? Wie lautet dann die rechtliche Analogie von gedruckten Notenblättern zu der Verwendung von Musik auf solchen Webseiten?

    Given that the Church is around since many centuries and has a set of sometimes very restrictive rules and belief systems, which topic would need to be reviewed and changed in order for the Church to be more attractive again? Should the open up to women in priesthood? Allowing openly gay priests? Should they abolish the infallibility of the Pope?
