  • When is earnest money deposited?

    We mailed off a check to our realtor agent(he should get it Monday). Our agent let us know that the seller gave us a verbal yes on accepting our bid but wouldn't be able to sign until a day after the deadline on the original contract and that they have a counter contract (btw this is a short sale). Since we don't have a signed agreement in place the earnest check can't be cashed yet, right? A house just popped up on the market that we are very interested in much more than the one we bid on. We do have a clause in our original contract that says we can back out of the contract anytime without penalty before lender approval but since they won't be able to sign before the deadline and have a counter we are out of it anyway,

  • Having "winterize home" in mortgage contract?

    We are planning on purchasing our first home in Colorado in October but won't be moving into it until the beginning of January(Army). I just stumbled upon "winterizing" homes. This is a problem for us since we won't be there to get this done and don't know anyone there to get this done for us. We will be flying into Colorado for a week in October to see houses and put in a bid; so we won't be there for all the closing and inspections. Would it be far fetched to put in the contract that we want the home winterized? It just seems like this would be our only resort since we won't be there to get it done.

  • Just got guinea pig, getting a playmate?

    I never had one before and just got it Saturday. I now read that they like to have buddies and would like to go back to the pet store and get another one. What would I need to do to make sure they get along? The one I currently have is a boy. I'm also in the process of putting together a C&C cage so it would be neutral territory since my current pig hasn't been in it. TIA!

  • Received notice of collection agency possibly suing me?

    I received a letter in the mail today from Portfolio Recovery stating that "my account has been selected for placement with a local attorney licensed in your state. If a law suit is filed against you and a judgement is obtained our local attorney may take any action legally in your state to collect this debt."

    First, I do know I am responsible for my debt and planned on paying it off eventually.

    It originally was a credit card with Providian for $3000. The collection agency has my balance as $4611.07 and still adding interest to it. My last payment was in the summer of 2004 and I opened the account in Texas. I'm not sure how SOL works for me since I moved from TX in Sept. 2005 to AZ . We have moved three times since then and are currently stationed in Hawaii.

    I'm unsure on what steps I can take towards this. I can't get a job because I have two small children (2 yr old and 1 month old) to take care of. I don't own anything. We are renting and our vehicles are in my husbands name so they couldn't sue me for anything like that.

    I could probably come up with $50 a month, do you think they would work with me on that? I know I should probably call, but I'm scared they will just demand all the money up front and I don't have that lying around.

    Any advice?

  • Refrigerator does not stay cold, landlord "looking" for new one for five months already?

    When we moved into this house they informed us they were looking for a new refrigerator. The landlord wanted it in a certain color, one that the doors open a certain way, and only wanted to pay about $900. She let us know that the current fridge still works. We found out that it doesn't work properly. We can not keep dairy in it-it spoils. A gallon of milk went bad within two days and it was stored all the way in the back. We actually had to go out and purchase a mini fridge to keep all our dairy products in. We had the repairman show up today to fix the toilets and when he checked out the fridge he agreed with us that it was not cold in there. It's even set on its highest setting. He talked to her and she told him that she was still looking for a fridge. =/ We live in Hawaii, there aren't a lot of places to look around at. She told him to have us look at our local military exchange for one the way she wants it. Is there any kind of regulation that states she needs to provide us with a properly working refrigerator?

  • Collection agency said statue of limitations starts over?

    My husband received a call from a collection agency (Portofolio Recovery?) about a 13 year old debt. It is obviously past the statue of limitations (TX resident). He told her this and she said when a new collection agency buys the debt it starts over-which I think is BS? This debt is not on his credit report but we are worried they will try and put this on there. Anyone have any info on how to deal with them? Thank you.
