  • Do I have a case against my former landlord?

    I rented a house for over two years. After moving out, I expected to receive my security deposit back or a written statement detailing any deductions made. In Colorado, the statute (38-12-103 and 104) dictates that the landlord must send the deposit and/or a written statement of deductions to the tenant s last known address. If the landlord neglects to do so within 30 days (can be extended to 60 days if stipulated in the lease) then they forfeit the right to withhold any of the deposit.

    My former landlord did not send anything by mail so I sent him a demand letter for the full amount. He responded via email stating that he sent a written statement (also via email) and that this means he has complied with the law.

    I disagree because he only sent something via email (which I did not receive) and did not send a hard copy to my last known address. I do not know why he neglected to do so as he sent any and all other legal correspondence through the US postal service. I intend to exercise my right to file a lawsuit against him, but wanted to get some opinions from others.

  • Does this count as identity theft/fraud?

    I received a 2017 W2 from a company I stopped working for in 2016. My final paycheck was actually issued on December 23, 2016.

    The W2 has my name, address, and social security number all listed correctly. I have spoken to someone at the company and was told they would look into it and call me in a few days.

    I am worried that either someone in the corporate office royally screwed up and it will take an act of God to fix it OR that someone had been using my SSN.

    Either way, I do not want to pay taxes on money I did not earn. I also do not want to find myself being investigated by the IRS.

  • Are employers legally supposed to pay employees to be "on call"?

    I work at a 24hour animal emergency clinic. We are supposed to sign up to be on call at least once a month.

    On call hours are supposed to be 6pm to 6am. Lately we've been getting slammed, especially on the weekends. The on call person ends up being called in before 6pm, working several hours, and going home. If it gets busy again, they are called back in.

    The managers have been talking about having two people be on call which means multiple on call shifts a month. This is being met with some anger because we do not get paid to be on call. We also feel like we can't make other plans on those days in case we are needed (Which is understandable for the 6pm to 6am time table, but not if we could be called in at any time).

    Someone mentioned that we are supposed to be getting paid for this kind of thing and adamantly refuses to take any more on call days until management agrees.

  • Can I sign up for short term disability if I think I might need a surgical procedure that will keep me from working?

    I have what I think is a medical condition that might require surgery to repair. I have not yet been to the doctor to get checked. If I am right and I do need surgery, my recovery will keep me from working for several weeks. I cannot afford to be out of work that long. Unfortunately I do not have any PTO saved up and only get 3 paid sick days. I would like to sign up for short term disability before seeing a doctor (to avoid the pre-existing condition label) so I will at least have that if I need it. I can t find any information about this, but feel it might be legally iffy. Please let me know

  • New grass growing in patchy?

    I moved into a rental house where the previous tenant did not take care of the lawn at all. Last fall I put down a bunch of new grass seed (sun and shade mix). This spring I repeated the application with a couple of times with different sun/shade mixes. I ve water faithfully when it didn t rain and put down 3 applications of fertilizer a couple of weeks apart. The grass is finally starting to grow in. In some places it s coming in thick and tall, but it others it s very sparce, thin, and somewhat short. The thicker spots look to be the Kentucky blue grass and are a nice deep green. The thin areas looks more like fescue and is much lighter in color. In the thinner areas are random patches of darker green that I think might be crabgrass. I m planning on seeding again in hopes of getting an even looking lawn. I m also going to put down weed and feed as soon as the weather allows. What can I do to promote germination without destroying the new growth that s already there? And how do I get a nice even looking lawn? I live in Colorado and the front lawn slopes from the house down to the sidewalk on the front and is fairly flat on the side. The front gets a lot of sun for most of the day and the side is shaded by a mature pine tree.

  • Can I enhance the quality of a picture taken with a cell phone?

    A friend took an amazing picture of my dogs and sent it to me on my cell phone. I really want to have it printed on a large canvas to hang, but the resolution is too low. Is there any way to increase the resolution without sacrificing the quality of the picture. Unfortunately my friend no longer has the original so I m stuck with the cell phone copy.

  • How do I tell my bosses that they suck at being bosses?

    I'm resigning from my job soon and I'm required to do an exit interview on my last day. I'm quitting because of how poorly the place is run.

    Examples: cleanliness seems unimportant, but, due to the type of business, it should be a priority. But it's not enforced on a routine basis. As a result, the place always feels at least a little icky.

    There's almost no follow through from the owners. If they disagree with a suggestion or idea, they simply ignore it instead of giving reasons why it won't work.

    They don't take very good care of their equipment and don't ensure their employees are taking care of it either.

    There's an overnight staff that are routinely left out of things/events. They often forget to buy them food for meetings (despite sending messages the same day saying that they will so people don't bring food with them).

    They make employees feel very unappreciated and the turn over rate has gone way up because of it.

    Essentially they've fostered an environment where no one really cares about their job or if they're doing it well or not.

    I've only worked at this place for about 6 months. At first I tried really really hard to make improvements, but it was like trying plow a field using a garden spade and someone was walking behind me and filling every thing back in.

  • How can my sister continue to lose weight?

    My sister was in an emotionally abusive relationship for several years. She was at a normal weight for her height when she net him, but her boyfriend systematically broke down her self esteem so she started gaining weight. He would guilt trip her if she didn t finish the massive amount of food he cooked and would accuse her of cheating if she tried to exercise. It wasn t until a physical for work revealed that she was diabetic and considered obese that she realized what he was doing to her. She left him and started working on a healthy lifestyle. She joined a roller derby team because they were very encouraging. She has since lost a significant amount of weight, increased her muscle mass, increased her endurance, and is no longer diabetic. But she plateaued. She says she knows it happens and wasn t so concerned with the number on the scale. She s tried increasing her cardio and the number of her overall work outs and anything her doctor has recommended, but has not seen any changes in her body and is becoming discouraged. Though she s obviously smaller than she used to be, she is still considered overweight. She just wants to be comfortable in her own skin again and I don t want her to lose the progress that she s made. Any suggestions would be appreciated.

  • Can they keep my deposit?

    I rented a townhouse from a management company. The deposit was $350 plus another $1,500 because of my credit. After a year, I decided to move into a larger unit. I paid another $350 deposit and the $1,500 was transferred to the new unit. A week after moving into the larger unit I was told I had violated my lease. A friend was coming over daily to walk my dog and occasionally would spend the night. I had made the leasing office aware of this prior to signing anything and they said it was fine as long as he didnt spend more than 7 nights in a row. Well, one of the maintenance workers decided to tell the leasing office that he had been spending every night for more than a month. I was told they would keep the rent I had already paid, the deposit, and the extra $1,500 I had already paid. In addition, I would be charged an additional $1,500 for the lease violation. In return, I was given until the end of the month to move and they wouldn t file to have me evicted. Next week marks 60 days since moving out of the original unit I had rented and 30 days since moving out of the larger unit. I know they have 60 days to either return the deposit or send a list of deductions and the reasons for them. After that, they give up any right to keep any part of the deposit and I can legally sue to get back 3 times the amount originally paid. But should I wait until it s been 60 days since moving out of the larger unit to try this? Assuming they don t do what they re supposed to.

  • Behavior issues in 8 year old?

    We re having several behavior problems with our 8 year old daughter.

    First, she will sometimes cry at the drop of a hat. If she s scared, upset, frustrated, tired, etc... not uncommon reasons, but other times, when going through the exact same events, she takes it in stride.

    Second, she gives up as soon as things get hard. She does this even if it s something she enjoys doing. She cries, whines, and complains until either she finally accomplishes the task or gets someone else to do it for her (usually by saying she doesn t know how or she forgot how or pretending to try and failing, even if it s something she s done before with no problem).

    Third, she is completely unapologetic when she gets in trouble. If she gets caught doing something she s not supposed to do (for example, lying) and she gets yelled at, she will start crying. When asked why she s crying, she will say it s because she doesn t like being yelled at. We explain why she s being yelled at and ask if she understands. We make her explain it in her own words to prove she understands. But the biggest thing is the fact that she has never, not even once, in her life apologized without being prompted to by someone else.

    Weve talked to her teachers and they recommend behavioral assessment. They do not offer it and it would cost around $3,000 out of pocket at a private center. She s a good kid and very sweet when she wants to be. I hate yelling at her or punishing her, but I m not sure what else to do.

  • Can I install a hidden camera at work?

    I am not the employer and my reason for asking is we have a community break room with open cubbies for personal belongings. The past two years I have been taking a prescribed controlled medication. I do not take it every day so a month's worth of pills has always lasted me well past 30 days. In June I noticed that I was just making it to my refill date before running out. I was a bit inconsistent about getting my refills so I didn't really think much of it, but I did mention it to my doctor. He decided to put me on an automatic refill program so I could keep better track. I started receiving them in the mail at the end of July. Three weeks later I was completely out. I figured I misplaced the rest and so asked to get an early refill. I got that 8/26/15. On 9/9/15 I counted my pills and realized I was missing some so I called my doctor. He uggested I keep a calendar of when I take my meds and how much I was taking so I've been doing that ever since. I got my most recent refill on 9/23/15. I counted my pills today and I am missing 6. All of my co-workers know that I keep my meds in my purse and it has never been an issue, but now I am convinced one of them has been stealing my meds.

  • Can I leave my 8 year home alone for an hour?

    I really need to start exercisin my dogs more because they get destructive when they're bored. I get home with my daughter around 6:30pm, but my husband doesn't usually get home until closer to 9pm . I've tried walking the dogs after he gets home, but I'm usually starting to get ready for bed about then (I have to get up around 5am to get ready for work). I've tried taking my daughter with me, but she walks very slowly and insists on picking up rocks and flowers and such. I don't mind that she does this, but I need to walk much faster in order for it to do any good. If I tell her we need to go, she will keep up the pace for about half a block before she starts complaining. So my only other option is to take the dogs out before my husband gets home and leave my daughter by herself for about an hour.

  • 2009 mini cooper s automatic gearbox warning light?

    I have a 2009 mini cooper s that I purchased a few months ago. About a week ago the automatic gearbox warning light started coming on intermittently. It's yellow and only seems to be when I'm turning the engine on or off. I cant get the car out of park or take the key out of the ignition when the light is on. I took it to where I bought it and they can't get the problem to repeat and they can't get their computer to run diagnostics so they're referring me to the manufacturer dealership. I have an appointment on Friday, but I'm hoping someone can give me a better idea about what's wrong and how much it'll cost to fix.

  • Is my landlord required to maintain the pool?

    I live in a townhouse complex that advertises two pool as part of the amenities package. So far this summer the pool closest to my unit has been closed several times for various reasons. They finally got it open a few weeks ago, but haven't been maintaining it. It's only been usable maybe 1/2 dozen times since. Most of the time it's this gross green color and there's dead leaves covering the surface. They even cut the filters off during the weekend. I've complained that it's unsanitary and unfair that I have to pay for something I don't get to use, but it doesn't help. What can I do?

  • How do I get people to stop baby talking to my 10 month old?

    I have a 10, almost 11, month old who is in the babbling stage. She seems to understand when I talk to her and will respond with noises. When she talks, I respond with actual words. For the most part, strangers tend to do the same, but family members do not. They repeat back the noises she makes or they stay stuff "do ooo want wubba duky" "is hers a biddle giwl? Do hers gots biddle ewars? And biddle toesies?" It drives me nuts and I've asked repeatedly for them not to do it. I've explained, very nicely, why I don't want them doing it. My main reason is kids of friends. The ones that allowed the baby talk and thought it was adorable when the kids started doing it. To some degree, all of these kids had to unlearn this behavior. But the worst case scenarios had to send them to speech therapy. One was so hard to understand that she had to have her therapist at school with her to translate until she could speak properly on her own. How do I get them to stop when I've asked and explained at least a dozen times already?

  • My 8 year old won't try anything even slightly difficult?

    This has been an issue for awhile. She constantly tells me "I cant" "it's too hard" etc... When something is even a little difficult, she shuts down. She asks others to do things for her or claims she forgot how. Or she pretends to try, but gives up quickly. Her dad and I try very hard to encourage her. We remind her about past successes. We ask her to really attempt something and only help her if she truly can't do it. We don't scold her for failures. She breaks down, she cries, she whines. Eventually she gets it. But I've noticed that her grandparents are constantly telling her "no, that's too heavy. I'll get it for you" or "no don't. That's too hard for you". Even if it's something she's done with no problem in the past. So 1. how can we get her to be more open to trying things and 2. how do we diplomatically tell her grandparents to stop discouraging her when she is trying?

  • Can my landlord do an inspection?

    I moved into a townhouse that has required maintenance a half a dozen times now. I always request they come on my day off so I can let them in. I have a dog who isn't nice with people coming in when I'm not there. She suffers from anxiety and will either hurt herself or destroy things if I lock her in a room. Maintenance doesn't seem to care because they keep coming over whenever they want. Nearly every time they come, my boyfriend is there. He does not live with me, but he stops by every day to let the dog out (I have to be at work very early and she cant hold it all day). Maintenance said something to the office and now they want to conduct a surprise inspection to make sure he's not living there. When I asked what they'd be looking for, they said "guy stuff like clothes or a razor. Things like that." I argued that finding those things does not prove he's living there. All it proves is I have "guy stuff" in my unit. And my boyfriend does keep things at my place for when he spends the night. I keep things at his place too. We make sure we abide by the complex rules for guests staying overnight. So are they really allowed to do this?

  • Almost 8 year old has started pouting, whining, crying, and complaining about nearly everything and I can't figure out how to make it stop.?

    Several months ago my daughter started pouting/crying whenever I asked her a question that could possibly be construed as negative.

    Example: Did you brush your hair this morning?

    Umm umm uhh (starts tearing up) noooo (sobbing).

    Can you please go brush your hair?

    Awww (stomps off mumbling to herself) it's not fair. Why do I always have to? I can't ever reach. It hurts my head.

    It's the same if I ask her to do something she does not want to do. Example: Hey, time to get ready for bed.

    Awww, but I thought I could stay up late. It's a school night and you know you need to be in bed by 8.

    (starts tearing up) It's not fair. You said I could stay up.

    No, I didn't, but it's 7:20 now. If you can finish by 7:30 then I will let you play until bedtime. Ooookaaayy (slumps off and returns 35 minutes later) I'm done. Can I watch a show?

    Sweetie, you only have 5 minutes until bedtime. You don't have time to watch a show. Awww, but you said I could plaaayyy. I said if you hurried, but you didn't hurry and now it's bedtime.

    Fiiine, I'll go to bed (walks off crying).

    I have tried ignoring her, talking to her, redirecting her, positive & negative reinforcement, punishment. All have resulted in varying degrees of escalation. It's every single day, several times a day. She does this at school too ("needs to try harder" "frustrated easily" "does not use time effectively" "tends to give up on difficult tasks") Aside from this, she is a sweet, funny, energetic kid who seems to enjoy life.

  • Colorado apartment manager sent an itemized list of deductions to an old address instead of the forwarding address I left with the office?

    I'm in a dispute with an apartment management company. I moved out of the complex at the end of March 2014. The apartment manager agreed to do the walk through with me after she returned from the post office. I waited for hours, but she decided to go home instead. I left my forwarding address in the rental drop box, but didn't hear anything. I sent a letter via certified mail requesting my security deposit back during the second week of May (in accordance with Colorado revised stature 38-12-103). I got proof of receipt at the end of May, but that was the last I heard from them. This week I applied for a new place, but was denied because my old complex said I owed them money. I left a message with my old complex asking for an explanation. Today I got a call from a collections company saying my old complex had sent me an itemized list of deductions a few days after I moved out, but they sent it to my old address at their complex. Obviously I didn't get it. They sent my file to collections at the end of April. Included in my file, was the note I left with my forwarding address. They had my new address so why wouldn't they send stuff there?
