  • Gifting encumbered home to child?

I am planning on gifting my home to my child.

I paid 200,000 for it and it has a 100,000 mortgage. My plan is to gift the house and then have my child take over the mortgage (provided everything works with the bank). My understanding is that because the mortgage is less than I paid for the house, even though the transaction is treated as a part sale, part gift, I will have no cancellation of debt income issues. Nor would I have any gain on the gift.

Does anyone agree or have any other thoughts?

  • Where to eat in disney for couples?

My husband and I are going to disney in February 2012 and will be staying on site (port Orleans French quarter). It is my first time in disney and we are trying to figure out where to eat (we are planning to stay in disney the entire time of our trip (6 days)).

We have a reasonable expectation on pricing but we would like some moderate suggestions as well (if there is such a thing in disney).

    Much appreciation for any suggestions!!

    Thank you!

  • Private loan foreclosure, do I need to have a 1099 prepared?

I am foreclosing on a private loan secured by a residential home. I privately financed the purchase of my home with a 100,000 loan (50,000) was put down. As I am foreclosing, do I need to have any sort of 1099 prepared. As this was a one time occurrence, and I am not in the trade or business of financing nor was the loan financed as a result of my trade or business I presume I do not need to file 1099-a or c. Any advice? Greatly appreciated!

  • What can I mix with tea?

I love tea, every flavor of it...what could I mix with it to make tea a cocktail? I'm looking for combinations of all flavors of tea, spiced tea, orange tea, peppermint tea, green tea, black tea, etc. Any tea you can think of...any ideas?

I posted the question here too if you'd rather get involved in a forum discussion.

  • Opinion what name sounds better for a law firm?

    Legal or Legal Group?

So it would be the last name of the managing partner with legal or legal group after it. For example, Smith Legal or Smith Legal Group.

    Any thoughts?

  • Looking to start a new law firm, question about sql server?

What is the difference between SQL and standard small business server. I am aware this is probably a very elementary question, I just wasn't sure if it was worth the extra costs. The server's sole purposes will be for running pc law (a billing software). Also the software will serve as a data management program, whereby we can use it to search any of the clients and associated documents related to those clients. Other than that, we may run exchange on the server or may outsource to save on IT costs. Otherwise, just the standard microsoft office suite and adobe.

    Any advice? Thanks in advance!

  • Clunking noise from front of Maxima. Any solutions?

I have a 2002 Maxima that started to recently make a clunking noise when accelerating and when I turn the steering wheel slightly to the left. I brought it to a well respected mechanic and had the following done checked:

    1. Control arms replaced (they were broken)

    2. Front axle replaced.

    3. CV joints, bearings, struts, and engine mount… checked.

The mechanic was very reasonable, only charged me for parts since he couldn't figure it out. I looked online and it seems like this is a common problem without a common solution. I am going to take it to another mechanic for a second opinion. Does anyone have any ideas? My mechanic seems to think that the only solution left would be to replace the transmission (which he advises against at this point, so he isn’t just trying to rip me off). Please help!
