In the context of international law, can a customary international law be considered binding prior to it s codification.?
For instance, can a state--or perhaps an individual (prior to the First Hague Convention) be held liable/accountable for killing combatants who have surrendered, despite the fact that this law of war was not codified as a part of international customary law until 1899?

1. Did Yahweh act as a realtor in parcelling out geographical Palestine? It seems a little like dogmatic religion to me.

Point in case: Israel has demanded not only that Palestine recognize its existence, or even its legitimacy, but that the PA recognize Israel as a Jewish state, while Israel has offered, at best, recognition of the PA as the sole representative of the Palestinians (limited to those in the occupied territories of course).

....) violate defendants' sixth amendment right to confront their witnesses and present evidence that is relevant? Evidence of sexual contact between alleged victims and others are prohibited by RSLs, and while most such evidence is irrelevant, it is not irrelevant per se.

1. Residents may be denied citizenship (and voting rights) purely on their ethnicity.
2. Jews in the West Bank are governed by civilian law, while non-Jews are not (and deprived of due process).
3. Israel is in violation of the Fourth Geneva convention, Article 49, section 6
4. Israel has kidknapped people from other countries, for alleged crimes, and denied them due process (see Vanunu).
5. In the last election, a government was formed by a block that did not amass a majority of the popular vote.
