I was recently charged with a minor in consumption, without having been drinking, and I'm curious as to my options.
I was sitting in the backseat of a vehicle that was pulled over for rolling through a stop sign. There were five passengers, including myself, in addition to the driver. One officer approached the drivers side and asked for her identification. Another officer approached the passenger side, I was the only individual with an I.D. which I handed to them. They pulled each individual out of the vehicle separately and they each submitted to a breathalyzer. Two individuals blew above a .00, but because they were below a .02, the officers did not issue a citation (the driver had not consumed any alcohol).
I was the last individual to be taken to the squad car. I was entirely cooperative, yet still aware of my rights. When I was in the squad car, they asked if I had drank anything tonight. I told them, correctly, no. I was then read my Miranda rights. Next, they explained the breathalyzer to me, told me that they would 'give me the same deal they gave my buddies', where if I blew below a .02, I would be let off. They asked if I consented to a breathalyzer and I politely refused to give my consent because I felt like I had no need to. I told them that I did not think they had cause to ask for a breathalyzer, to which they responded they smelled a strong stench of alcohol in the vehicle when they initially approached it. At this point, they asked what my major was in college, and then asked if it was pre-law (because I understood my rights at the time). The two officers left the car and one officer approached the vehicle that I was pulled over in. I was later informed that they had asked this group two questions, 1) What my major was and if I was pre-law, and 2) how much I had drank. I am unsure if my friends said my major, but they did say that they had no knowledge how much I drank or if I had even consumed any alcohol at all.
Then, the officers came back to the squad car and cuffed me. While they were filling out the paperwork, I requested a field sobriety test and as the paperwork was nearly completed, I believe (not 100% certain) that I requested a breathalyzer as well so that I would not need to deal with going to the correctional facility. I was told no to both (or at least to the field sobriety test, again I am not 100% certain if I requested the breathalyzer, but I believe that I did). When I asked what their grounds were to arrest me, they stated that I had bloodshot eyes (I was in the back of a dimly lit cop car, it was 1:30 a.m., and they did not shine a light in my eyes or anything similar to check), that I smelled of alcohol (I may have, I was around others drinking and may have had alcohol spilled on me), and that I was slurring my speech, which I do not believe that I was.
When I was booked at the correctional facility, one of the booking officers actually asked me 'what they got me for', and was surprised when I said minor in consumption, because I was not displaying any signs of being intoxicated or of smelling like alcohol. I was not given a blood test and was released on bail almost immediately.
In short,
-I refused a breathalyzer initially
-My later request for a field sobriety test (and I believe a breathalyzer) was denied
-I was not given a blood test at the correctional facility
-The only evidence the officers have is supposedly bloodshot eyes, stench of alcohol, and slurring of speech.
How can I fight this? Also, will this be publicized prior to the court hearing?

So I just came across my old Ipod nano 3g and I'm trying to get it working again. For some reason, even though I've restarted the software, I cannot move past the 'select language' screen. Neither the touch wheel or the select button works. However, I can still do a hard restart using the select button and pushing up, so I know the buttons themselves work. Any suggestions on what to try?

So yesterday afternoon I noticed that something was sliding around inside my computer; it sounded metallic. Then, my computer shut off randomly a few hours later when I was using it. Startup repair eventually fixed it temporarily (I had to try it many times because it kept crashing). After it had worked for a few hours, it crashed again today and startup repair is unable to fix it. The computer will get to various points in the booting process and then just shut down. The sliding sound has stopped leading me to believe that whatever piece it is is now lodged somewhere. Any idea what this is?
Another interesting tidbit: Some VAIO's have a "one touch web access" feature, where the OS doesn't actually boot up, just a sony web browser. I'm currently using this right now. Why does this work but the actual OS cannot start up?

I'm considering purchasing an ss supercharged (not the later-model turbo version) and I've listened to a few Youtube videos of them. They all make the supercharger sound very whiny and high pitched, like a toy car. Are they actually really loud/high pitched?
Obviously, I would see one of the vehicles before I buy it, but I want to make sure the drive is worth it.

I know this is a long shot, but I'm in the middle of a fairly intense traffic appeal case: one that has the potential for me to lose my license. Basically, I was cited for speeding- I wasn't, at least not to the cited degree. If the officer presents video evidence from his patrol vehicle that shows him committing a traffic offense in it of itself, is this evidence admissible (would I be cleared from any degree of speeding)? Obviously this is a minute law violation, but is there a principle which would support me here?

I'm going to court today, and I was wondering what color shirt I should wear beneath my suit. I understand that blue is generally a noble color which sends off a message of truth, however it is also a very passive color. I am a minor fighting a charge most would not, and am using very advanced methods to do this. This means that I have to gain some credibility as well, such as that could be gained with red or black. However, could these colors be too belligerent? What should I do?

So a violation I'm going to court for is cited under Municipal code as a misdemeanor, yet state code and another section of the Municipal code classifies the violation as a noncriminal offence. This gives them the right to make the court case a "preponderance of evidence (need 51% of evidence)" case instead of a "beyond a reasonable doubt" case. The state code outlines this as well. Bottom line-- I want my case to be a beyond a reasonable doubt case. Since I'm being charged with a misdemeanor, don't I have the right? The state code says the proceedings should be brought about as if it is a civil case, yet the city is bringing about the charges, making it a criminal case. What can I do?

I'm appealing a prior courts decision of finding me guilty of speeding. I"m appealing it because I was not speeding, I have evidence that confirms this, and the burden on my insurance is too great to go down without a fight. I'm appealing, so here are two questions....
1-The officer made many mistakes on my ticket including writing the wrong ordinance violation, writing the wrong address of the offence, and writing the wrong school I attend. Although this is a very minor part of my case, how do I present this effectively? Is there some statute that makes it invalid? What is the technical way that I should do this?
2- In my first hearing, the judge ruled under the precept that the prosecution's burden of proof was a "preponderance of evidence." Since this is technically a criminal charge, a misdemeanor, isn't the burden "beyond a reasonable doubt?" How can I address this properly in court?

So a few months ago flash drives stopped working on my laptop. I've tried all the usb inputs-- none of them work. I've tried several different flash drives and none of them work. It says I need to install a driver (doesn't say this on other computers) and the drivers for various flash drives are nearly impossible to find for vista. The computer sometimes doesn't even recognize them. Again, this problem arose fairly recently; they did used to work. I'm running windows vista. What can I do?
