Student Loans & Bankruptcy?

After four years of college, part time at a two year college, I still do not have my degree, I have gotten a divorce, and ended up having to file bankruptcy because of some things my ex-husband done right before our divorce was final. My lawyer advised me that Federal Student Loans cannot be included in a bankruptcy; however, I am curious to know if that includes student loans that have been consolidated through an organization such as EdFinancial. Does anyone have any knowledge about this issue?

A consolidated student loan is still a student loan and a debt that you cannot include in bankruptcy. Just because you consolidated several loans does not make them disappear. The debt servicer changes now and then, but the guarantor you borrowed from is still the Dept. of Education.

Doesn't matter. Federal Student Loans cannot be discharged through bankruptcy. I suppose you might get lucky if the loan consolidator is asleep at the switch. However, they are likely to protest and you won't get away with it.

Are you a Canadian citizen? while you're, then you definately would stay away from paying the debt via shifting back to Canada. in any different case, this shall no longer artwork. regrettably, the student loans rules have been written against the debtors. The creditors have each and every of the capacity and benefit.
