Yellow jackets make their home underground too especially if there is rotting wood. Their bodies tend to be a bit longer than honey bees and they have brighter yellow markings than honey bees.A lot of people mistake them for honey bees. I would say this is probably what you are seeing. Because it is in an area near your pool, you would be wise to get some wasp killer and spray the nest. As long as you don't disturb them they are fine but disturb the nest in any way and they will attack in numbers. Be well protected when you spray and stand well back. Wasp killer will send our a long spray so there is no need to go that close

I'm not sure about honey bees, try a general internet search on honey bee nests for that one.
In my area, if we find bees nesting in the ground they are yellow jackets. If this is near where people go, I'd say it should be taken care of. They are a danger to people as well as pets, and if it is yellow jackets they will also cause problems any time anyone has food around.
