If my boyfriend's babys mother gives up her rights to their son, can I adopt him?

My boyfriends baby mama is losing her custody battle with him and now she is stating that she wants to give up her rights. My boyfriend and I have been together 3 years and we talked about me adopting him to be his "legal" mother. We just arent sure if there are stipulations that are required to do this.. by the way we live in missouri.. any answers would help

A judge is not going to approve an adoption since you aren't committed enough to marry. Except under extraordinary circumstances, single people cannot adopt a child 'together'. A child is not a playtoy that you can continue to play house with.

However, just like a father, a mother can't just give up her rights. She can give up legal custody, but unless an adoption has been approved, she can change her mind in future and file again for custody rights.

The one Answerer who said bio-ma should pay support is wrong. The bio-parent is NOT required to pay support after adoption & IMO shouldn't feel obligated.
You can't have your cake & eat it too!!
If you want bio-ma out of the pic, you have to have her TOTALLY out of the pic when it concerns child support.
The bio-ma will have to sign a paper consenting to the adoption before you can adopt the child. I live in Michigan, so I'm not sure of all the other specifics that would apply to you living in Missouri.

The state of missouri does offer step parent adoption in cases where rights of one parent are either terminated or given up. Missouri requires that you and B/F be married for at least 6 months before you can file your best bet is to consult an attorney, the one he is using for custody would be best. and see what else you may have to do.

i think of we are lacking something here. Why became into there no formal custody settlement? Does your husband pay baby help? If he does he needs to bypass to courtroom. He might desire to have had a custody settlement interior the 1st place so she might desire to no longer jerk him around. He has thoroughly performed into her palms. He desires a legal expert ASAP. And he shouldn't sign something. A impartial place might desire to be his attorneys workplace.
