I was pulling out of a drive way and I was more than halfway out since no cars were there and all of a sudden i got hit by a car . I was already out of my spot and saw the car coming but she never stopped she hit my car and damaged hers but when she hit my car she was still pressing the gas and finally stopped when she realized she hit me. Shes 17 and has provisional license and im 19 been driving for 2yrs...

When you pull of of a driveway you have to yield the right of way to oncoming traffic. That means it would be your fault. But you then say you were out of a parking space. That makes it unclear on whether you were backing out of a parking space, which would be your fault, or pulling out of a driveway into the street, which would also be your fault. Were you pulling out of a parking space or driving out of a driveway into the street? Either way, your fault. Just be clear on how the accident happened. And, were you stopped or moving at the time? Were you turning right or left when it happened. Turning would also be your fault.
Since she hit the side of your car it is likely to fall on you for failure to yield right of way. She was spaced out enough not to brake but you should have been on the road by then. If she had hit the back of your car it would be her fault.
Your fault. She wasn't supposed to yield the right of way to somebody in a driveway. You were supposed to make sure it was clear before proceeding. Sounds like you freaked her out, poor thing, and she didn't step on the brakes as fast as she could have. Doesn't matter that you were half way out. Doesn't matter the age either.
