So I had a mystery shopper at my store tonight and I dont smoke so I sit down behind the counter to take my break and was playing on my phone while my coworker was at register and she takes a picture of me sitting down so now how screwed am I since we will fail because of me?

It depends what the mystery shopper has to give points for. Such as was customer greeted, were the employees name tags visible, did the employee try to sell other products, visible tattoos etc. I would say that being behind the register with your phone isn't a fail but I could see that as points taken off, especially if your boss didn't allow it. Take your break in the back next time. And if they talk to you about it just tell them it won't happen again.
