Traffic Laws?

Question

Hello everyone,

My question is if I’m working on the side of the road is it legal for me to redirect traffic around me? That may include traffic traveling in the opposite lane for a short period of time, maybe no more than 150 feet at any given time. Essentially we would be moving down the road as the day goes on so we’d be like a “moving roadblock” in a sense. I will have an employee activity monitoring traffic at all times to best assist motorists while passing through my work zone. I’m just wondering if it is legal for me to do, I typically see a lot of landscaping companies and construction companies doing something similar but I’m not sure if they need a permit to do that or not. If you don’t have my answers can you please redirect me to a place where I can find them?

Legally you need an encroachment permit.

It is ILLEGAL for you to be doing work that requires redirecting traffic without coordinating with local law enforcement.

you need to contact the PD, they will likely require you to hire an off duty cop for traffic control...who will then just sit in a car and ignore traffic while you pay for his services.

it would be a liability for you to take control of traffic.

sometimes there is a flag man, but he is not directing traffic, just waving a safety flag to increase visibility to drivers.
