Have last bag Phone made. love it, don't want to give up using it! help?!!!!!!!!!!!?

I got a very nasty Note from US Cellular informing Me that I must give up My beloved Bag Phone, or Pay a "Non-Compliance Fee " if I elect not to give up My Bag Phone, that all Cell Phones must now be GPS , per FCC Rules.I Posted this Question before, and one of the Responses I got stated that My Original Contract is binding, and They can't cut off My Phone, legally. If and when I get a New phone, then and only then will I be Forced to get a New Phone. Aslong as My current Phone works, US Cellular can't deny Me Service, or force me to get a New Phone. Could Someone please Quote Me the Rules and Regulations on that Issue, and let Me know just what my Rights are, so I can inform US Cellular? Since this is an FCC Issue, the Rules should be the same all over the U.S.A., right? Please let me know ! Thanks !!!!!!!!!!

Probably not the last bag phone made, I know a lot of folks in rural areas still use them- even some cell company field techs still use them! You can't beat the power output. But the reality is that in order to comply with FCC rules regarding E911 USC wants to move you to the new phones on their CDMA network because they chose a phone solution with GPS to e911 phase 2 location. I think they need to have between 85 and 95% of their customers using the compliant phones. Keep in mind with your bag phone if you call 911 they will be able to tell what cell site (tower) you are using, but not a close location. So if you do call be sure to have an address or good directions.

Secondly by the end of 2007, carriers are no longer required to support the analog networks. Some carriesr have reduced the number of sites that have analog, maintaining only the bare number needed to meet the FCC rules. So you may not be getting the service you used to get. Once the analog is gone you will need to get a new phone.

You should be able to keep your phone if you want to until the analog is gone- a non compliance fee is simply a rise in cost. It is not fedrally mandated.

But look into other carriers in the meantime. You may find a better company locally who will provide you with better service

If you read the terms and conditions on your contarct it states that they (your service provider) has the right to change, modify, deny service if they wish. It will also state that any changes made to one part of the contract does not impact any other part of the contract. They can claim that they want you to get in new phone because it will be in your best interest. The GPS phone that they are requiring you to get is for E-911 location. With a bag phone, a tower will not give the 911 operators information on where you are calling from.

On a side note, all cell compaies are going away from the analog network that your bag phone operates on. Basically, your phone will be useless to you in less than a year anyways. Sorry :(

I think it might be better if you were able to seek legal advice to your problem. Here in the UK we have something called the Citizens Advice Bureau....possibly there is something similar where you live....

"The Citizens Advice service helps people resolve their legal, money and other problems by providing free, independent and confidential advice, and by influencing policymakers.

Every Citizens Advice Bureau is a registered charity reliant on trained volunteers and funds to provide these vital services for local communities."

    Good Luck
