At what age can children decide to go on holiday in Australia?

I am divorced and my 2 children live with my ex-wife. I want to take them overseas for 2 weeks for a holiday, my ex-wife refuses permission. I have been told at 16 they can decide for themselves, has anyone had this problem and does this age sound right.

Update:

They'll be going on holiday with me, im not planning to force them, they may just enjoy it.

    Well, You can go to court real quick and ask the court. According the the visitation agreement my husband has with his ex (we have custody) There is no first right of refusal and alls each party has to provide is a written letter 30 days before vacation and information on how to contact, plane flight, etc.

    We were going to take his daughter out of state for vacation, his ex refused, we went to court and the judge clearly stated each party has the right to go on vacation with the daughter there is no right to refusal. UNLESS, there is proof (documented) that you are not going to give the child back.

    File a motion, you dont need a lawyer, it is real easy I have written ALL ofmy husbands paperwork for court and he has won every time.

    This is hard because you are not rally giving them the freedom to decide on their lifes. You are in fact trying to negotiate with your ex. You may be right and 16 can be a good age to start making this kind of choices, but you have to sell the idea to your ex first. If they can be involved in the process is better, but make sure that they don´t end up as referees on a fight between you and your ex. If they have something to say, let them say it. If they can work and help with the cost of the trip then they should be allowed to go, simply because it builds their self steem and gives them a good chance to prove themselves worthy.

    If your sending them by themselves, then they are too young. if you are accompanying them, its perfect. i went to aussie by myself when i was 18, and it was the single greatest time of my life, take them, they will love it!!!
